PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Hyundai Motor Manufacturing Alabama, LLC (EPA Identification Number ALR000025486), which operates an automotive manufacturing facility located at 700 Hyundai Boulevard in Montgomery, Montgomery County, Alabama.

The violations consisted of the following: sending hazardous waste to a facility that is not authorized to receive hazardous waste, failure to perform adequate waste determinations, failure to keep satellite accumulation containers closed, failure to properly label satellite accumulation containers, failure to keep containers of hazardous waste closed, failure to post “No Smoking” signs wherever there is a hazard from ignitable or reactive waste, failure to provide central accumulation areas with sufficiently impervious bases, failure to properly label containers of hazardous waste, failure to restrict unauthorized access to central accumulation areas, failure to post warning signs at each entrance to central accumulation areas, failure to keep containers of universal waste lamps closed, failure to properly label universal waste batteries, failure to properly label universal waste aerosol cans, failure to demonstrate the length of time universal wastes have been accumulated, failure to keep containers of used oil closed, failure to properly label containers and tanks of used oil, failure to maintain written job descriptions for each position related to hazardous waste management, and failure to provide documentation that copies of the contingency plan and quick reference guide have been submitted to local emergency responders.

The Department is proposing a civil penalty in the amount of $16,760. The Order, if issued, would require Hyundai Motor Manufacturing Alabama, LLC to comply with all applicable requirements of Division 14 of the ADEM Administrative Code.

Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention Stephen A. Cobb, Chief of the Land Division, P.O. Box 301463, Montgomery, Alabama 36130-1463. The comment period shall end at the close of business 30 days from the publication date of this notice.
