PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Huxford Pole & Timber Company, Inc. (EPA Identification Number ALD008185407), which operates a wood treating facility located at 14200 Highway 21 North in Huxford, Escambia County, Alabama.

The violations consisted of the following: failure to properly label satellite accumulation containers, failure to restrict access to central accumulation areas, failure to keep containers of used oil closed, failure to properly label containers of used oil, failure to post warning signs at each approach to the active portion of the facility, failure to properly operate and maintain groundwater monitoring wells, failure to provide required records/documents for review, failure to maintain and operate the facility to minimize the possibility of release of hazardous waste to the environment, and storage of hazardous waste for greater than ninety days without a permit.

The Department is proposing a civil penalty in the amount of $14,560. The Order, if issued, would require Huxford Pole & Timber Company, Inc. to comply with all applicable requirements of Division 14 of the ADEM Administrative Code.

Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention Stephen A. Cobb, Chief of the Land Division, P.O. Box 301463, Montgomery, Alabama 36130-1463. The comment period shall end at the close of business 30 days from the publication date of this notice. A nominal fee for copying may be charged.
