NOTICE OF PROPOSED RENEWAL AND VARIANCE OF A CONSTRUCTION/DEMOLITION
WASTE LANDFILL PERMIT UNDER THE ALABAMA SOLID WASTES AND RECYCLABLE
MATERIALS MANAGEMENT ACT AND REQUEST FOR COMMENTS

DALE COUNTY
The Dale County Commission has applied to the Alabama Department of Environmental Management (ADEM) for renewal and variance of the Solid Waste Disposal Facility Permit for the Dale County C/D Landfill (Permit 23-06). The Permittee requested a variance from ADEM Admin. Code 335-13-4-.12(2)(f) requiring a 100-foot buffer zone. The proposed variance would allow for a 50-foot buffer zone around Cells 4 and 5.
The waste stream for the Dale County C/D Landfill would remain non-putrescible and non-hazardous construction and demolition waste, tires, and rubbish as defined by ADEM Admin. Code 335-13-1-.03. The service area for the Dale County C/D Landfill would remain Dale County, Alabama. The maximum average daily volume of waste disposed at the Dale County C/D Landfill would remain 65 tons a day.
The landfill is located in Sections 12 and 13, Township 5 North, Range 24 East in Dale County, Alabama. The permitted facility consists of approximately 272.33 acres with 40.02 acres for disposal operations.
Copies of the public notice, permit application, and proposed permit are available for public inspection via the ADEM web site at http://adem.alabama.gov/public-notices, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm by appointment. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 35 days following the publication date of this notice. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.
A written request for a public hearing may also be filed within that 35-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing upon receipt of a significant number of technical requests.
After consideration of all oral and written comments and consideration of the requirements of the Alabama Solid Wastes & Recyclable Materials Management Act, and all other applicable regulations, the Department will make a final determination on the proposed permit. The Department will develop a response to comments, which will be posted to the Department’s website at http://app.adem.alabama.gov/eFile/.
