PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Baldwin County Sewer Service, LLC for UIC Permit Number ALSI9902013, Fort Morgan Treatment Plant, located at 16763 AL Hwy 180, Gulf Shores, Baldwin County, Alabama.The violations noted in the Consent Order consist of exceedances in flow volumes and Biological Oxygen Demand limits. Other violations include unpermitted discharges in the form of Sanitary Sewer Overflows (“SSO”), and failure to submit required reports to the Department within 24 hours after becoming aware of a notifiable SSOs.
The Department is proposing a civil penalty in the amount of $18,000. The Order, if issued, would require Baldwin County Sewer Service, LLC to submit an Engineering Report that addresses corrective actions and outlines a Compliance Plan with a schedule for implementation of necessary corrective actions, and a complete UIC permit modification application to achieve compliance with applicable rules, regulations, and Permit conditions. In addition, the Order would require Baldwin County Sewer Service, LLC to submit a report summarizing the feasibility of an alternate wastewater discharge option.
