PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to ATC LLC, the owner/operator of at least one gasoline transport vessel currently operating in Irvington, Mobile County, Alabama.

The violations consisted of allowing gasoline to be transferred between a Tank Truck and a gasoline storage tank, without a valid ADEM or Jefferson County Department of Health Air Sticker.

The Department is proposing a civil penalty in the amount of $4,000. The Order, if issued, would require ATC LLC to pay the Alabama Department of Environmental Management within 45 days of the effective date, and comply with the terms, limitations, and conditions of the Permit and Department’s regulations immediately.

The comment period shall end at the close of business 30 days from the publication date of this notice. A nominal fee for copying may be charged.
