PROPOSED CONSENT ORDER
Colbert County
Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Tennessee Valley Authority- Power Service Center (TVA-PSC) (EPA Identification Number AL2640090005), which owns/operates a facility to maintain and repair the equipment that is operated by TVA in the generation and distribution of electrical power, located at 3100 Reservation Road in Muscle Shoals, Colbert County, Alabama.
The violations consisted of the following: not giving ADEM notice for grading and road paving at SWMU 65; transporting waste with a transporter that did not have a valid EPA identification number or an Alabama Hazardous Waste Transporter Permit; failure to operate to minimize the possibility of a fire, explosion, or any unpermitted sudden or non-sudden release of hazardous waste or hazardous waste constituents to air, soil, surface water, or groundwater which could threaten human health or the environment; and failure to determine if a solid waste is hazardous.
The Department is proposing a civil penalty in the amount of $26,500. The Order, if issued, would require TVA-PSC to comply with the terms and conditions of its current Hazardous Waste Facility Permit and all applicable requirements of Division 14 of the ADEM Administrative Code.

The comment period shall end at the close of business 30 days from the publication date of this notice. A nominal fee for copying may be charged.
This notice is hereby given this 8th day of September, 2023, by authorization of the Alabama Department of Environmental Management.
