NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

COLBERT COUNTY

Great Southern Wood - Tuscumbia Inc, PO Box 610, Abbeville Alabama 36310, NPDES Permit Number AL0071226, located at 1703 Denton Road, Tuscumbia, Alabama 35674 for reissuance of a permit, which authorizes discharges resulting from stormwater runoff associated with wood preservative chemical treating operations and outside lumber storage discharging through Outfall DSN001 to an Unnamed Tributary to Spring Creek, classified as Fish and Wildlife, in the Tennessee River Basin; stormwater runoff associated with wood preservative chemical treating operations, outside lumber storage, and petroleum storage, handling, and fueling areas discharging through Outfalls DSN002, and DSN003 to an Unnamed Tributary to Spring Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

MORGAN COUNTY

Nucor Steel Decatur LLC, 4301 Iverson Boulevard, Trinity, AL 35673, NPDES Permit Number AL0070068, located at same address, for reissuance of a permit, which authorizes discharges resulting from non-contact cooling water and stormwater associated with steel mill operations through outfall DSN001 to an Unnamed Tributary to the Tennessee River,  classified as Fish & Wildlife; non-contact cooling water and stormwater runoff associated with steel mill operations through outfall DSN002 to an Unnamed Tributary to the Tennessee River, classified as Fish & Wildlife; stormwater runoff associated with steel mill operations through outfall DSN003 to an Unnamed Tributary to the Tennessee River, classified as Fish & Wildlife; stormwater runoff associated with steel mill operations though outfall DSN004 to the Tennessee River, classified as Public Water Supply, Swimming, Fish & Wildlife; non-contact cooling water blowdown, reverse osmosis concentrate, softener backwash, carbon filter backwash and stormwater associated with steel mill operations through outfall DSN007 to an Unnamed Tributary to the Tennessee River, classified as Fish & Wildlife; stormwater runoff associated with steel mill operations through outfall DSN011 to an Unnamed Tributary to the Tennessee River, classified as Fish & Wildlife and stormwater associated with steel mill operations through outfall DSN012 to an Unnamed Tributary to the Tennessee River, classified as Fish & Wildlife.  All discharges are located in the Tennessee River Basin. The entity providing water to the permittee is a public water system in accordance with Section 1401 of the Safe Drinking Water Act; therefore, the permittee is exempt from the requirements of Section 316(b) of the federal Clean Water Act.

WASHINGTON COUNTY

Linde, Inc., 1636 Industrial Road, McIntosh, AL 36533, NPDES Permit Number AL0067687, located at same address, for modification of a permit, which authorizes discharges resulting from air compressor condensate, hydrogen compressor condensate, hydrogen superheater condensate, cooling tower blowdown, reverse osmosis reject water and contaminated stormwater through  Outfall DSN001 to an Unnamed Tributary to the Tombigbee River which is classified as Fish & Wildlife, in the Tombigbee River Basin.

BARBOUR COUNTY

Imerys – Refractory Minerals USA, Inc. – Gachet Pits, 377 Highway 131, Eufaula, Alabama 36072, NPDES Permit Number AL0082520, located on County Road 79 South, Eufaula, Barbour County, Alabama, for issuance of a permit that limits discharges of treated drainage from a bauxitic and kaolin clay mine and associated areas, discharging to Groundwater, Piney Woods Creek, and an unnamed tributary to Piney Woods Creek, classified as Fish and Wildlife, in the Choctawhatchee River Basin.

HOUSTON COUNTY

Houston County Commission – Pea Market Pit, 462 North Oates Street, Dothan, Alabama 36303, NPDES Permit Number AL0081311, located at 1923 Pea Market Road, Columbia, Houston County, Alabama, for issuance of a permit that limit discharges of treated drainage from a dry preparation sand and/or gravel mine and associated areas, discharging to an unnamed tributary to Hurricane Creek, classified as Fish and Wildlife, in the Chattahoochee River Basin.

JEFFERSON COUNTY

Best Coal, Inc. – Sloan Mountain Mine No. 3, 9865 Highway 269, Parrish, Alabama 35580, NPDES Permit Number AL0024287, located on Knob Mine Road, Warrior, Jefferson County, Alabama, for reissuance and modification of a permit that limit discharges of treated drainage from a dry preparation coal mining operation and associated areas, discharging to Locust Fork, an unnamed tributary to Locust Fork, and Campbell Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

MOBILE COUNTY

Manning Trucking, Inc. – Turkey Farm Road Pit, 5209 Industrial Road, Pascagoula, Mississippi 39581, NPDES Permit Number AL0080241, located at 12152 Turkey Farm Road, Grand Bay, Mobile County, Alabama, for issuance of a permit that limits discharges of treated drainage from a construction sand gravel and dirt and/or chert mine and associated areas, discharging to Groundwater and an unnamed tributary to Franklin Creek, classified as Fish and Wildlife, in the Escatawpa River Basin.

PICKENS COUNTY

General Shale Brick, Inc. dba Columbus Brick -  Phillips Pit, PO Box 9630, Columbus, Mississippi 39705, NPDES Permit Number AL0079324, located at 7197 Salem Road, Gordo, Pickens County, Alabama, for reissuance and modification of a permit that limits discharges of treated drainage from a shale and/or common clay mine and associated areas, discharging to an unnamed tributary to Bear Creek, classified as Fish and Wildlife, in the Upper Tombigbee River Basin.

Public, Semi-Public and Private Facilities

TUSCALOOSA COUNTY

Tuscaloosa County Board of Education, PO Box 2568, Tuscaloosa, AL  35403, NPDES Permit Number AL0050661, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Northside School Lagoon, 19230 Northside Parkway, Northport, AL  35475, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto an unnamed tributary to Barbee Creek, which is classified as Fish and Wildlife, in the Black Warrior River Basin.

The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations; and for those in the coastal area, are consistent with the Alabama Coastal Management Program.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
