PROPOSED CONSENT ORDER
Greene County
Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to the City of Eutaw Lagoon, NPDES Permit Number AL0044067, located on Bull Run Road, Eutaw, Greene County, Alabama.
The violations noted in the Consent Order consist of unpermitted discharges in the form of Sanitary Sewer Overflows (“SSO”), deficiencies noted in the March 30, 2022, compliance inspection, and failure to submit required reports to the Department after becoming aware of a notifiable SSO.
The Department is proposing a civil penalty in the amount of $4,900. The Order, if issued, would require the City of Eutaw to prepare a report addressing the need for changes in maintenance and operating procedures, modification of existing treatment and collection system works, additional treatment and collection system works, a plan for continued maintenance and assessment of the collection system to minimize inflow and infiltration, and an investigation into the ownership and maintenance responsibilities for the Boligee Industrial Park lift stations. The Order, if issued, would also require submittal of semi-annual progress reports; the immediate cessation of all unpermitted discharges from the lagoon; compliance with all Permit conditions; rehabilitation, repairs, and upgrades to the collection system and lift stations; and submittal of a compliance certification.
