NOTICE OF PROPOSED CONSENT ORDER

Tuscaloosa County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to the City of Tuscaloosa (Ed E. Love Water Treatment Plant), NPDES Permit Number ALG640061, located at 1125 Jack Warner Parkway, Tuscaloosa, Tuscaloosa County, Alabama.

The violations noted in the Consent Order were an unpermitted discharge, exceedances of numeric permit limits, and failure to properly provide spill prevention, control, and/or management sufficient to prevent any spills of pollutants from entering a water of the state.

The Department is proposing a civil penalty in the amount of $22,600.00.  The Order, if issued, would require the City of Tuscaloosa to pay the penalty, submit an Engineering Report detailing the cause(s) and the repairs / corrective measures to address the non-compliance, submit a certification of compliance, and comply with all Permit conditions.

 The comment period shall end at the close of business 30 days from the publication date of this notice.  A copy of the proposed order is available on the ADEM web page at http://adem.alabama.gov/compInfo/adminOrders.cnt  or may be obtained by written request to the above address.  A nominal fee for copying may be charged.

This notice is hereby given this 7th day of September, 2022, by authorization of the Alabama Department of Environmental Management.
