NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

BALDWIN COUNTY

Alleo Energy Bay Minette Plant - Bay Minette Energy LLC, 12020 D'Olive Street, Bay Minette, AL 36507, NPDES Permit Number AL0084445, located at same address, for initial issuance of a permit, which authorizes discharges resulting from Stormwater associated with the production of biodiesel and its by-products, fire testing water, and air conditioner condensate, through DSN001 to Whitehouse Creek which is classified as Fish & Wildlife, in the Mobile River Basin. ADEM Administrative Rule 335-6-10-.12 requires applicants to new or expanded discharges to Tier II waters demonstrate that the proposed discharge is necessary for important economic or social development in the area in which the waters are located.  The Department has reviewed the application and determined that the applicant has demonstrated that the proposed discharges to Tier 2 waters are necessary for important economic and social development.

JEFFERSON COUNTY

Ergon Asphalt & Emulsions, Inc., 7890 Birmingport Road, Mulga, AL 35118, NPDES Permit Number AL0082996, located at same address, for Reissuance of a permit, which authorizes discharges resulting from Hydrostatic test water and Storm water associated with the storage, loading, and production of asphalt through Outfalls DSN001 and DSN002 to Short Creek which is classified as Fish & Wildlife, in the Black Warrior River Basin.

The Sherwin-Williams Company, 90 Carson Road, Birmingham, AL 35215, NPDES Permit Number AL0043109, located at same address, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff, boiler blowdown and non-contact cooling water through DSN001 to an Unnamed Tributary to Cunningham Creek which is classified as Fish & Wildlife, in the Black Warrior River Basin.

MADISON COUNTY

Saint Gobain Ceramics, 219 Cap Adkins Road SE, Huntsville, AL 35803, NPDES Permit Number AL0000299, located at same address, for reissuance of a permit, which authorizes discharges resulting from once through non-contact cooling water and storm water through DSN001 to Tennessee River (Hobbs Island Inlet) which is classified as Public Water Supply and Fish and Wildlife, in the Tennessee River Basin. The cooling water intake structure used by the permittee has been evaluated using available information.  At this time, the Department has determined that the cooling water intake structure represents the best technology available (BTA) to minimize adverse environmental impact in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C. section 1326).

Smyrna Ready Mix, LLC - SRM Plant #3007, 1000 Hollingshead Circle, Smryna, TN 37129, NPDES Permit Number AL0083267, located at 656 Palmer Road, Madison, AL 35758, for reissuance of a permit, which authorizes discharges resulting from stormwater associated with the manufacture of concrete products through outfalls DSN001 and DSN002 to an Unnamed Tributary to Bradford Creek which is classified as Fish & Wildlife, in the Tennessee River Basin.

Gulf States Enterprises, Inc. – Gulf States Enterprises Pit, 8905 Utreiner Avenue, Pensacola, Florida 32534, NPDES Permit Number AL0084310, located at 18786 Greek Cemetery Road, Robertsdale, Baldwin County, Alabama, for issuance of a permit that limits discharges of treated drainage from a construction sand, gravel, shale, and common clay mine and associated areas, discharging to an unnamed tributary to Blackwater River, classified as Fish and Wildlife, in the Perdido River Basin.

Imerys Refractory Minerals USA, Inc. – Oma Threatt Pit 5E, 377 Highway 131, Eufaula, Alabama 36072, NPDES Permit Number AL0055930, located off Highway 131, Baker Hill, Barbour County, Alabama, for issuance of a permit that limits discharges of treated drainage from a kaolin and bauxitic clay mine and associated areas, discharging to an unnamed tributary to Piney Woods Creek, classified as Fish and Wildlife, in the Chattahoochee River Basin.

CALHOUN COUNTY

Vulcan Construction Materials, LLC – Coldwater Quarry, 1200 Urban Center Drive, Birmingham, Alabama 35242, NPDES Permit Number AL0069892, located at 423 Rock Quarry Road, Oxford, Calhoun County, Alabama, for issuance of a permit that limits discharges of treated drainage from a wet and dry preparation crushed and broken quartzite mine and associated areas, discharging to an unnamed tributary to Choccolocco Creek, in the Coosa River basin.

HENRY COUNTY

Imerys Refractory Minerals USA, Inc. – Espy Pit, 377 Highway 131, Eufaula, Alabama 36072, NPDES Permit Number AL0056227, located off Highway 95, Eufaula, Henry County, Alabama, for issuance of a permit that limits discharges of treated drainage from a kaolin and bauxitic clay mine and associated areas, discharging to Abbie Creek, all classified as Fish and Wildlife, in the Chattahoochee River Basin.

Imerys Refractory Minerals USA, Inc. – Carter Pit #2, 377 Highway 131, Eufaula, Alabama 36072, NPDES Permit Number AL0071196, located off Henry County Road 204, Abbeville, Henry County, Alabama, for issuance of a permit that limits discharges of treated drainage from a bauxitic and kaolin clay mine and associated areas, discharging to Wells Branch, all classified as Fish and Wildlife, in the Chattahoochee River Basin.

JACO-Wilfork Pit, PO Box 400, Excel, Alabama 36439, NPDES Permit Number AL0079219, located at 4318 North Butler Street, Frisco City, Monroe County, Alabama, for revocation, reissuance, and modification of a permit that limits discharges of treated drainage from a wet preparation construction sand and gravel mine and associated areas, discharging to unnamed tributaries to Big Escambia Creek and Big Escambia Creek, classified as Fish and Wildlife, in the Conecuh-Sepulga River Basin.

The subject permit regulates the discharge of treated wastewaterand stormwater runoffto Wolf Creek, which is classified as Fish and Wildlife in the Perdido River Basin.

CHEROKEE COUNTY

The Utilities Board of the Town of Cedar Bluff, PO Box 306, Cedar Bluff, AL 35959, NPDES Permit Number AL0024678, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Cedar Bluff Wastewater Treatment Plant, 3710 Boundary Avenue, Cedar Bluff, AL 35959, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Chattooga River (Weiss Lake), classified as Swimming and Fish and Wildlife, in the Coosa River Basin.

DALLAS COUNTY

The Waterworks and Sewer Board of the City of Selma, PO Box 326, Selma, AL  36702, NPDES Permit Number AL0022578, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and stormwater runoff from Valley Creek WWTP, 1 Marina Drive Selma, AL  36701, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterand stormwater runoff to the Alabama River (Dannelly Lake) which is classified as Fish and Wildlife, in the Alabama River Basin.

JACKSON COUNTY

Scottsboro Water, Sewer and Gas Board, PO Box 550, Scottsboro, AL 35768, NPDES Permit Number AL0031372, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from Scottsboro Southside WWTP, 318 Camille Street, Scottsboro, AL 35769, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Tennessee River (Guntersville Lake), classified as Swimming/Fish and Wildlife, in the Tennessee River Basin. The subject permit also regulates the discharge of storm water runoff to Roseberry Creek (Guntersville Lake), classified as Fish & Wildlife, in the Tennessee River Basin. The subject permit also regulates the discharge of storm water runoff to UT to Roseberry Creek (Guntersville Lake), classified as Fish & Wildlife, in the Tennessee River Basin.

Stevenson Utilities Board, 42274 US Highway 72, Stevenson, AL 35772, NPDES Permit Number AL0021351, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Stevenson Wastewater Treatment Lagoon, 807 Kentucky Avenue, Stevenson, AL 35772, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Crow Creek (Guntersville Lake), classified as Public Water Supply, Swimming, and Fish and Wildlife, in the Tennessee River Basin.

JEFFERSON COUNTY

SRD Holdings, LLC, PO Box 1002, Gardendale, AL  35071, NPDES Permit Number AL0084344, for initial issuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Ponderosa WRF, Ponderosa Lane, Morris, AL  35116, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto Turkey Creek, which is classified as Fish & Wildlife, in the Black Warrior River Basin.

LAWRENCE COUNTY

West Morgan/East Lawrence Water and Sewer Authority, PO Box 2254, Decatur, AL  35609, NPDES Permit Number AL0048585, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Town of Courtland HCR Lagoon, 970 Yeager Avenue, Courtland, AL 35618, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto Big Nance Creek, which is classified as Fish and Wildlife, in the Tennessee River Basin.

PICKENS COUNTY

Water Works & Sewer Board of the City of Aliceville, 311 3rd Avenue NW, Aliceville, AL  35442, NPDES Permit Number AL0056332, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Aliceville West Lagoon, SW Corner of Aliceville City Limits near McCall Bottom Road, Aliceville, AL  35442, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto the Tombigbee River (Gainesville Lake), which is classified as Swimming and Other Whole Body Water-Contact Sports (S),Fish and Wildlife (F&W), in the Tombigbee River Basin.

Water Works & Sewer Board of the City of Aliceville, 311 3rd Avenue NW, Aliceville, AL  35442, NPDES Permit Number AL0020770, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Aliceville East Lagoon, 11th Street SE Aliceville, AL  35442, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto the Lubbub Creek, which is classified as Fish and Wildlife (F&W), in the Tombigbee River Basin.

 

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
