PROPOSED CONSENT ORDER
Baldwin County
Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management (ADEM) is proposing to issue a Consent Order to Hathaway Development LLCwhich operates Exchange at Daphne, ALR10C0NF, located in the city of Daphne, Baldwin County, Alabama.
The violations consisted of commencing and continuing NPDES construction activity without implementing effective BMP’s producing non-compliant discharges.
The order, if issued, would require the operator to pay a civil penalty in the amount of $22,000.
Interested persons may submit written comments, including request for a hearing within 30 days of the publication date of this notice, to:
