PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Arkema, Inc., the owner/operator of a chemical manufacturing production facility currently operating in Axis, Mobile County, Alabama.

The violations consisted of failing to comply with particulate emission limits for the D-200 Dryer A and Dryer B units and failure to operate the Durastrength Dust Collector Baghouse in a manner to minimize emissions.

The Department is proposing a civil penalty in the amount of $60,000.  The Order, if issued, would require Arkema, Inc. to pay the Alabama Department of Environmental Management within 45 days of the effective date, submit a revised maintenance plan for the control equipment associated with the Durastrength Dryer A and Durastrength Dryer B units within 45 days of the effective date, and operate in compliance with ADEM Admin. Code 335-3.
