The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

CLAY COUNTY

Koch Foods of Ashland LLC, 515 Tyson Road, Ashland, AL 36251, NPDES Permit Number AL0082449, located at the same address, for reissuance of a permit which authorizes discharges resulting from stormwater runoff associated with poultry processing and equipment maintenance activities, through DSN001 to an unnamed tributary to Horsetrough Creek, classified as Fish & Wildlife, in the Tallapoosa River Basin; stormwater runoff associated with poultry processing and vehicle fueling operations, through DSN002 to an unnamed tributary to Horsetrough Creek, classified as Fish & Wildlife, in the Tallapoosa River Basin; and stormwater runoff associated with poultry processing, through DSN003 into Horsetrough Creek, classified as Fish & Wildlife, in the Tallapoosa River Basin.

Southern Mineral Resources, LLC - Arkadelphia Preparation Plant, 1915 County Road 8, Hanceville, Alabama 35077, NPDES Permit Number AL0022837, located at 1915 County Road 8, Hanceville, Cullman County, Alabama, for issuance of a permit that limits discharges of treated drainage from a wet and dry preparation coal mining operation with incidental sandstone and associated areas, discharging to Dollar Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

North Alabama Sand and Gravel, LLC, PO Box 1045 Decatur, Alabama 35602, NPDES Permit Number AL0068900, located at 2113 County Road 75, Phil Campbell, Franklin County, Alabama 35581, for reissuance and modification of a permit that limits discharges of treated drainage from a dry and wet preparation construction sand and gravel mine and associated areas, discharging to Wilson Branch, Kennedy Branch, unnamed tributaries to Wilson Branch, and unnamed tributaries to Kennedy Branch, classified as Fish and Wildlife, in the Tennessee River Basin.

Callen Enterprises, Inc. – Lowndesboro Pit, PO Box 39, Lowndesboro, Alabama 36752, NPDES Permit Number AL0061344, located at 897 US Hwy 80 East, Lowndesboro, Lowndes County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation construction sand and gravel, dirt and/or chert mine, and associated areas, discharging to Groundwater and unnamed tributaries to Dry Creek, classified as Fish and Wildlife, in the Alabama River Basin.

Central Alabama Aggregates, LLC – Shorter Pit, 2285 Zelda Road, Montgomery, Alabama 36001, NPDES Permit Number AL0084458, located US Hwy 80, Shorter, Macon County, Alabama for issuance of a permit that limits discharges of treated drainage from a wet preparation dirt and/or chert, construction sand and gravel mine and associated areas, discharging to Groundwater and an unnamed tributary to Cubahatchee Creek, and unnamed tributaries to Calebee Creek, classified as Fish and Wildlife, in the Tallapoosa River Basin.

MONTGOMERY COUNTY

Capitol Materials, LLC – Graham/Matthews/Waugh Pit, 5755 Carmichael Parkway, Montgomery, Alabama 36117, NPDES Permit Number AL0070637, located at 18623 Hwy 80 East, Pike Road, Montgomery County, Alabama, for reissuance and modification of a permit that limits discharges of treated drainage from a dry preparation construction sand and gravel, red clay mine, and associated areas, discharging to Groundwater and an unnamed tributary to Line Creek, classified as Fish and Wildlife, in the Tallapoosa River Basin.

Baldwin County Sewer Service, LLC, 14747 Underwood Road, Summerdale, AL 36580, NPDES Permit Number AL0083470, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and stormwater runoff from Summerdale WWTF, County Road 36, Summerdale, AL 36580, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Negro Creek and stormwater runoff to Negro Creek and an Unnamed tributary to Negro Creek, which are classified as Fish and Wildlife in the Perdido River Basin.

CULLMAN COUNTY

Cullman Utilities Board, PO Box 278, Cullman, AL 35056, NPDES Permit Number AL0082091, for reissuance of a permit which limits the discharge of pollutants from filter backwash from Cullman Filter Plant, 1740 3rd Street S.E., Cullman, AL 35055, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of filter backwash to UT to Eightmile Creek, classified as Fish and Wildlife, in the Black Warrior River Basin. The subject permit also regulates the discharge of storm water monitoring from the sludge impoundment area to UT to Eightmile Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

LIMESTONE COUNTY

StructCon, LLC, 17738 Hampton Cove Way, Athens, AL 35611, NPDES Permit Number AL0084495, for initial issuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Browns Ferry Marina & Development WWTP, Nuclear Plant Road, Athens, AL 35611, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Tennessee River (Wheeler Lake) which is classified as Swimming, and Fish and Wildlife in the Tennessee River Basin.

PIKE COUNTY

City of Troy, PO Box 549, Troy, AL 36081, NPDES Permit Number AL0032310, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and stormwater runoff from Troy Walnut Creek WWTP, 588 County Road 3355, Troy, AL 36079, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to Walnut Creek, which is classified as Fish and Wildlife, in the Choctawhatchee River Basin.

City of Troy, PO Box 549, Troy, AL 36081, NPDES Permit Number AL0084466, for initial issuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and stormwater runoff from Big Creek WWTP, Mullins Place, Troy, AL 36079, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to an unnamed tributary to Big Creek, which is classified as Fish and Wildlife, in the Choctawhatchee River Basin.

SHELBY COUNTY

City of Alabaster, 1953 Municipal Way, Alabaster, AL 35007, NPDES Permit Number AL0025828, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and stormwater runoff from Alabaster WWTP, 104 8th Avenue NW, Alabaster, AL 35007, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to Buck Creek, which is classified as Limited Warmwater Fishery, in the Cahaba River Basin.

City of Calera, 7901 Highway 31, Calera, AL 35040, NPDES Permit Number AL0074608, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and stormwater runoff from Camp Branch Water Reclamation Facility, 255 Training Center Dr., Calera, AL 35040, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to a UT to Camp Branch, which is classified as Fish & Wildlife, in the Coosa River Basin.

ST CLAIR AND ETOWAH COUNTY

Town of Steele, PO Box 425, Steele, AL 35987, NPDES Permit Number AL0072729, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Steele Lagoon, Duncan Farm Road, Steele, AL 35987, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Little Canoe Creek, which is classified as Fish and Wildlife, in the Coosa River Basin.


The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations; and for those in the coastal area, are consistent with the Alabama Coastal Management Program.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record. The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.
