PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Kronospan, LLC, the owner/operator of a medium density fiber board and particle board manufacturing facility currently operating in Eastaboga, Calhoun County, Alabama.

The violations consist of Cogen control device malfunctions, MDF temperature data collection issues, and late Annual Compliance Certification (ACC).

The Department is proposing a civil penalty in the amount of $243,000. The Order, if issued, would require Kronospan to pay the Alabama Department of Environmental Management within 45 days of the effective date, and comply with the terms, limitations, and conditions of the Permit and Department’s regulations immediately.
