MODIFICATION UNDER THE ALABAMA SOLID WASTES & RECYCLABLE MATERIALS
MANAGEMENT ACT AND REQUEST FOR COMMENTS

Big Sky Environmental, LLC has submitted to the Alabama Department of Environmental Management (ADEM) an application for renewal and modification of the Solid Waste Disposal Facility Permit for a municipal solid waste landfill known as the Big Sky Environmental LLC Solid Waste Facility, Permit No. 37-48. Modifications include revisions to the Operations Plan, including addition of Enviro-Cover as an alternate daily cover material, implementation of railyard operations, and plans for a scrap tire processing facility. The waste stream for the Big Sky Environmental LLC Solid Waste Facility municipal solid waste disposal area would remain non-hazardous solid wastes, non-infectious putrescible and non-putrescible wastes including but not limited to household garbage, commercial waste, industrial waste, construction and demolition debris, appliances, tires, trees, limbs, stumps, dried sludge, ashes, paper and other similar type materials, and special waste approved by ADEM. The waste stream for the Big Sky Environmental LLC Solid Waste Facility construction and demolition waste disposal area would remain nonputrescible and nonhazardous construction and demolition waste and rubbish as defined by ADEM Admin. Code 335-13-1-.03, and tires. The service area for the Big Sky Environmental LLC Solid Waste Facility would remain the contiguous United States. The maximum average daily volume of waste disposed at the Big Sky Environmental LLC Solid Waste Facility would remain 25,000 tons per day. An extension of the previously approved variances was requested and would be granted in the renewed permit. All other permit conditions would remain the same.

The Big Sky Environmental LLC Solid Waste Facility is described as being located in Section 18 and 19, Township 16 South, Range 4 West and Sections 13, 14, 23 and 24, Township 16 South, Range 5 West in Jefferson County, Alabama. The Big Sky Environmental LLC Solid Waste Facility consists of 1522.7 acres with 66.24 acres approved for municipal solid waste disposal and 95 acres approved for construction and demolition waste disposal.

Copies of the public notice, the permit application, and proposed permit are available for public inspection electronically via www.adem.alabama.gov/newsEvents/publicNotices.cnt and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm by appointment. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 35 days following the publication date of this notice. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 35-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Solid Wastes & Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request. Notice will be sent to any person requesting notice of the final action.
