NOTICE OF REQUEST FOR A REVIEW OF A COASTAL CONSISTENCY VARIANCE FOR AN ACTIVITY REQUIRING A
FEDERAL LICENSE OR PERMIT

In accordance with ADEM Administrative Code r. 335-8-1-.14, the Alabama Department of Environmental Management (ADEM) hereby gives notice that Long Bayou Housing Development has applied to the ADEM for a variance pursuant to ADEM Admin. Code r. 335-8-1-.13.

Long Bayou Housing Development requests a variance from ADEM Admin. Code r. 335-8-2-.11. and seeks authorization to construct a low-impact residential community on approximately 45 acres, including 6.41 acres of wetland and waterbottom impacts. The development will feature 32 single-family lots, a 30-unit condominium building, a 26-slip marina, and supporting infrastructure such as roadways, a 3,500-foot-long walkway, and a new 4-foot-deep channel. Project activities will include 2.3 acres of wetland filling, 3,259 cubic yards of dredging for the channel, and 3,334 cubic yards for marina access. Dredged material will be used onsite. This is proposed on parcels 05-61-07-36-0-000-001.000 and 05-61-07-36-4-001-002.000 in Orange Beach, Baldwin County, Alabama. The proposal is being reviewed by the U.S. Army Corps of Engineers under SAM-2023-00942-BAL. Mitigation for wetlands impacts would be through the purchase of mitigation credits from an approved mitigation bank.

Any person wishing to make comments or provide additional information relative to the proposed activity’s consistency with the ACAMP must submit such comments or information by letter or by email to ADEM at the address below within fifteen (15) calendar days following the publication date of this notice. Only those comments which address issues within the Department’s scope of authority can be considered. All correspondence regarding this proposal must reference application number ACAMP-2024-054.

Copies of all information submitted are available for public inspection at the ADEM office located at the above address Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. Arrangements for review and copying should be made in advance. These documents related to this proposed action and documents otherwise related to this facility also may be viewed at the Department’s eFile system located at http://app.adem.alabama.gov/eFile/ by selecting Media Area “Water,” entering the application number in place of the “Permit Number,” and pressing Search.

After consideration of all written comments and consideration of the requirements of the Alabama Coastal Area Management Act and ADEM Coastal Program rules, the Department will make a final determination. The Department’s determination, associated documents and all comments received during the public comment period will be available for inspection at the ADEM office located at the above address during normal working hours and on the Department’s eFile system. Notice of the final decision will be sent to any person who requests such notice in writing during this comment period.
