PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to East Alabama Lumber Company, Inc, the owner/operator of a softwood sawmill facility currently operating in Lafayette, Chambers County, Alabama.

The violations consisted of certification of inaccurate information by the Responsible official and failure to conduct visible emissions observations.

The Department is proposing a civil penalty in the amount of $20,000. The Order, if issued, would require East Alabama Lumber Company, Inc to pay the Alabama Department of Environmental Management within 45 days of the effective date, and comply with all requirements of ADEM Administrative Code div. 335-3 and its revised Air Permits immediately upon the issuance of the revised Air Permits.
