PROPOSED CONSENT ORDER
Morgan County
Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Ready Mix USA, LLC, the owner/operator of a concrete batch plant currently operating in Trinity, Morgan County, Alabama.
The violation consisted of excessive visible emissions from the silo bag filter vent, violating ADEM Admin. Code r. 335-3-4-.01.
The Department is proposing a civil penalty in the amount of $10,000. The Order, if issued, would require Ready Mix USA, LLC to pay the Alabama Department of Environmental Management within 45 days of the effective date, and to comply with the Department’s regulations immediately.

The comment period shall end at the close of business 30 days from the publication date of this notice. This notice is hereby given this 15th day of November, 2023, by authorization of the Alabama Department of Environmental Management.
