NOTICE OF PROPOSED SYNTHETIC MINOR OPERATING PERMIT
AND REQUEST FOR COMMENTS

Hosea O. Weaver & Sons, Inc., has requested a change to its Synthetic Minor Operating Permit for a 400 TPH Double Barrel Drum-Mix Asphalt Plant located at 1908 Bay Bridge Cutoff Road, Mobile, Alabama 36110-3502.  The application requests additional limits on allowed hours of operation and on the amount of fuel oil which can be burned. Emissions would be minimized by continued utilization of a baghouse, as well as limiting operating hours to 3,700 hours per consecutive twelve (12) month period and fuel oil usage to 1,800,000 gallons of fuel oil per consecutive twelve (12) month period.

ADEM has determined that the permit changes proposed by the company meet State and federal air pollution control requirements.

Persons wishing to comment may do so, in writing, to the Department’s named contact below within 15 days following the publication date of this notice.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed application.  All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.

A written request for a public hearing may also be filed within that 15-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Air Pollution Control Act, the Federal Clean Air Act and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be posted to the Department’s eFile system.

Copies of the complete project file are available for public inspection Monday through Friday (except legal holidays), 8:00 a.m. to 5:00 p.m., at the ADEM Main Office at the address listed above.  For convenience, documents that exist in electronic format may be accessed in the Department's document management system, eFile.  To view these documents, select Media Area “Air”, enter the facility number shown above as the Permit Number, select Document Type “Permitting”, and press Search.  The most recent documents will be listed at the top by default.  The Document Type may also be left blank, which will list all electronically available air files for this facility.
