PROPOSED CONSENT ORDER
Morgan County
Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Bunge North America, SID Permit Number IU085200103, located at 1400 Market Street Northeast, Decatur, Morgan County, Alabama.
The violations noted in the Consent Order consist of discharging pollutants in violation of the limits imposed by Part I.A of the Permit.
The Department is proposing a civil penalty in the amount of $24,600. The Order, if issued, would require Bunge North America to submit an Engineering Report that identifies the potential causes of noncompliance, summarizes an investigation of the changes necessary for the Permittee to achieve and maintain compliance with the Permit, and outlines a Compliance Plan with a schedule for implementation for necessary corrective actions to comply with all Permit conditions.
