NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

CALHOUN COUNTY

Gold Bond Building Products, LLC, 4811 US Highway 78 West, Oxford, AL 36203, NPDES Permit Number AL0003930, located at the same address, for reissuance of a permit, which authorizes discharges resulting from process wastewater from gypsum liner board manufacturing, seal water, cooling water, condensate, RO system reject water, air compressor blowdown, boiler blowdown, and storm water through  DSN001 to Choccolocco Creek which is classified as Fish and Wildlife, in the Coosa River Basin; Storm water runoff associated with gypsum board liner paper manufacturing through  DSN002-DSN007 to Unnamed Tributary to Coldwater Spring Branch which is classified as Fish and Wildlife, in the Coosa River Basin. The Department has determined that the facility is not subject to Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326) since the facility uses well water for cooling water.

DE KALB COUNTY

JCG Foods of Alabama LLC, 764 George Cagle Drive, Collinsville, AL 35961, NPDES Permit Number AL0002241, located at same address, for reissuance of a permit, which authorizes discharges resulting from process wastewater and noncontact cooling water through DSN001 to Big Wills Creek classified as fish and wildlife, in the Coosa River Basin, and storm-water associated with poultry processing operations through DSN002, DSN003, and DSN004 to Big Wills Creek classified as fish and wildlife, in the Coosa River Basin. The Department has determined that the facility is not subject to Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326) since the entity providing water is a public water system.

U S Army - US Army Redstone Arsenal, Building 4488, Martin Road, Redstone Arsenal, AL 35898 NPDES Permit Number AL0000019, located at same address, for reissuance of a permit, which authorizes discharges resulting from Storm water runoff from DDT remediation area through  DSN001 to Unnamed Tributary to Huntsville Spring Branch which is classified as Fish and Wildlife, in the Tennessee River Basin; MORGAN COUNTY

Wayne Farms, LLC - Decatur Fresh Processing Plant, 4110 Continental Drive, Oakwood, Georgia 30566, NPDES Permit Number AL0082619, located at 254 Ipsco Street, Decatur, Alabama 35601, for reissuance of permit which authorizes discharges resulting from stormwater runoff associated with poultry processing operations discharging through Outfall DSN001 to Bakers Creek, classified as Swimming, Fish & Wildlife in the Tennessee River Basin; stormwater runoff from outdoor storage of trailers, totes, materials, and equipment associated with poultry processing operations discharging through Outfall DSN002 and Outfall DSN003 to Bakers Creek, classified as Swimming, Fish & Wildlife in the Tennessee River Basin.  In accordance with ADEM Administrative Rule 335-6-10-.12, the Permittee has demonstrated that the proposed discharges are necessary for important economic or social development in the area in which the waters are located.

BLOUNT COUNTY

Tremendous Stone, LLC – Rocky Mountain Quarry, PO Box 1786, Oneonta, Alabama 35121, NPDES Permit Number AL0083950, located at 76 Rocky Mountain Road, Oneonta, Blount County, Alabama, for modification of a permit that limits discharges from sandstone mine and associated area, discharging to an Unnamed Tributary to Calvert Prong, classified as Fish and Wildlife, in the Black Warrior Basin.

Whitaker Contracting Corp – Brooksville Sand Quarry, PO Box 306, Guntersville, Alabama 35976, NPDES Permit Number AL0075680, located at 222 Jones Road, Blountsville, Blount County, Alabama, for reissuance and modification of a permit that limits discharges of treated drainage from a wet and dry preparation industrial sand mine and associated areas, discharging to Mill Branch, an unnamed tributary to Mill Branch, and an unnamed tributary to Big Spring Creek, all classified as Fish and Wildlife, in the Black Warrior River Basin.

JEFFERSON COUNTY

Alden Resources, LLC – Kimberly Mine, 332 West Cumberland Gap Parkway, Corbin, Kentucky 40701, NPDES Permit Number AL0082465, located at 9061 Pritchett Road, Gardendale, Jefferson County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry and wet preparation coal mining operation and associated areas, discharging to Locust Fork, all classified as Fish and Wildlife, in the Black Warrior River Basin.

The subject permit regulates the discharge of treated wastewater to Hollinger Creek, which is classified as Fish and Wildlife in the Perdido-Escambia River Basin.

CHAMBERS COUNTY

City of LaFayette, PO Box 87, Lafayette, AL  36862, NPDES Permit Number AL0062839, for reissuance of a permit which limits the discharge of pollutants from treated domestic from Mill Creek WWTP, 1146 County Road 48 Lafayette, AL 36862, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto Mill Creek, which is classified as Fish and Wildlife, in the Tallapoosa River Basin.

CHOCTAW COUNTY

North Choctaw Water & Sewer Authority, PO Box 77, Lisman, AL  36912, NPDES Permit Number AL0073270, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from North Choctaw WWTP, Banks Lane, Lisman, AL  36912, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto the Tuckabum Creek, which is classified as Fish and Wildlife (F&W), in the Tombigbee River Basin.

Sheffield Utilities, PO Box 580, Sheffield, AL 35660, NPDES Permit Number AL0050121, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Sheffield WWTP, 700 Furnace Drive, Sheffield, AL 35660, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Tennessee River (Pickwick Lake), classified as Fish and Wildlife, in the Tennessee River Basin.

Town of West Point, PO Box 1641, Cullman, AL 35056, NPDES Permit Number AL0051136, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from West Point WWTP, 4314 County Road 1141, Cullman, AL 35057, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to UT to Crooked Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

The subject permit regulates the discharge of treated wastewaterto Black Creek, which is classified as Fish and Wildlife, in the Black Warrior River Basin.

Jefferson County Commission, Richard Arrington Jr. Blvd. N, Suite A-300, Birmingham, AL  35203, NPDES Permit Number AL0067067, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and stormwater runoff from Leeds WRF, 800 Helen Street, Leeds, AL  35094, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater tothe Little Cahaba River and stormwater runoffto Dry Creek, which are both classified as Fish & Wildlife, in the Cahaba River Basin.

LOWNDES COUNTY

The Water Works and Sewer Board of the Town of Fort Deposit, Inc., PO Box 340, Fort Deposit, AL  36032, NPDES Permit Number AL0024155, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Fort Deposit WWTF, 260 Old Fort Road West, Fort Deposit, AL  36032, for the purpose of meeting federal and state water quality regulatory standards. PIKE COUNTY

City of Brundidge, PO Box 638, Brundidge, AL  36010, NPDES Permit Number AL0044105, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from Brundidge WWTP, 500 Cleanwater Drive, Brundidge, AL  36010, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto Whitewater Creek, which is classified as Fish and Wildlife, in the Choctawhatchee River Basin.

TALLADEGA COUNTY

City of Talladega, 100 North Court Street, Talladega, AL  35160, NPDES Permit Number AL0022349, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from Talladega Brecon WWTP, 525 Welch Avenue, Talladega, AL  35160, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto the UT to Kelly Creek, which is classified as Fish and Wildlife (F&W), in the Coosa River Basin.

TUSCALOOSA COUNTY

Duncanville Wetlands, LLC, PO Box 86, Duncanville, AL  35456, NPDES Permit Number AL0078841, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Duncanville Wetlands WWTF, 14985 Bear Creek Road, Duncanville, AL 35456, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto the Big Sandy Creek, which is classified as Fish and Wildlife, in the Black Warrior River Basin.

The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations; and for those in the coastal area, are consistent with the Alabama Coastal Management Program.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
