PROPOSED CONSENT ORDER

Autauga County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management (ADEM) is proposing to issue an Order to LCS Unlimited, LLC, Autaugaville Pit, Expired ALG890814, County Road 19 North in the town of Autaugaville, Autauga County, Alabama, Petrunic Pond Pit, Expired ALG890830, Neighbors Farm Pond Pit, Expired ALG890834, and Pearson Property, ASN890P-4TF2-GBA, County Road 19 North, which are located on County Road 19 in the city of Prattville, Autauga County, Alabama.

                                                      
The violations consisted of: unpermitted and/or noncompliant discharges; effective BMPs not implemented and/or maintained; commencement/continuation of regulated activity prior to obtaining valid ADEM NPDES permit coverage; noncompliance with applicable ADEM rules and permit requirements.

 

The order, if issued, would require the operator to: apply for and obtain NPDES permit coverage; perform corrective actions; implement and maintain effective BMPs; comply with applicable ADEM rules and permit requirements; pay a civil penalty in the amount of $42,320.
