PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Carmeuse Lime and Stone, Inc., the owner/operator of a lime and stone manufacturing facility currently operating in Saginaw, Shelby County, Alabama.

The violations include failure of a particulate matter stack test on No. 4 Kiln over the permit limit, and failure to complete a particulate matter stack test on No. 5 Kiln within the required 12-month time frame.

The Department is proposing a civil penalty in the amount of $120,000.  The Order, if issued, would require Carmeuse Lime and Stone, Inc., to pay the Alabama Department of Environmental Management within 45 days of the receipt date of the final Consent Order, and comply with the terms, limitations, and conditions of the Permit and the Department’s regulations according to the schedule outlined in the Consent Order.

The comment period shall end at the close of business 30 days from the publication date of this notice.  A copy of the proposed Order is available on the ADEM web page at http://adem.alabama.gov/compInfo/adminOrders.cnt, or may be obtained by written request to the above address.  A nominal fee for copying may be charged.
