NOTICE OF REQUEST FOR COASTAL AREA MANAGEMENT PROGRAM PERMIT
PUBLIC NOTICE - 591

The Alabama Department of Environmental Management (ADEM) hereby gives notice that Chicago Deer River Property, LLC has applied for a Coastal Area Management Program Permit in accordance with ADEM Administrative Code Division 335-8.

Chicago Deer River Property, LLC proposes to perform maintenance dredging at the existing vessel barge loading/unloading dock adjacent to their Theodore Industrial Port property. The footprint of the area to be dredged to the previously-permitted depth of -42 feet below MHW measures approximately 1,700-feet-long by 150-feet wide (5.85 acres). Approximately 15,000 cubic yards of material would be removed from the waterbottoms by mechanical dredge and placed into a hopper barge. The material would then be temporarily placed within an existing 150-foot-long by 200-foot-wide (0.69-acre) concrete containment dike at the west end of the site for dewatering. A check dam would be constructed near the low point in the dike to filter sediment-laden runoff prior to its release into the existing storm drainage system, which discharges back into the Theodore Industrial Canal. The proposed facility is located at 2460 Claudia Ln in Theodore, Mobile County, Alabama.

Any person wishing to make comments or provide additional information relative to the proposed activity’s consistency with the ACAMP must submit such comments or information by letter or by email to ADEM at the address below within fifteen (15) calendar days following the publication date of this notice. Only those comments, which address issues within the Department’s scope of authority, can be considered. All correspondence regarding this proposal should reference application number 2011-236.

Copies of all information submitted are available for public inspection at the ADEM office located at the above address Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. After consideration of all written comments and consideration of the requirements of the Alabama Coastal Area Management Act and ADEM Coastal Program rules, the Department will make a final determination. The Department’s determination, associated documents and all comments received during the public comment period will be available for inspection at the ADEM office located at the above address during normal working hours.  Notice of the final permit decision will be sent to any person who requests such notice, in writing, during this comment period.
