SUMTER COUNTY

Arcosa LW BR LLC, PO Drawer V, Livingston, AL 35470, NPDES Permit Number AL0083526, located at 201 South Industrial Park Road, Livingston, AL 35470, for modification of a permit, which authorizes discharges resulting from stormwater associated with the manufacture of lightweight aggregate through DSN001, and stormwater and noncontact cooling water associated with the manufacture of lightweight aggregate through DSN002 to an unnamed tributary to Sucarnoochee River, classified as Fish & Wildlife, in the Tombigbee River Basin. At this time, the Department has determined that the cooling water intake structure used by the Permittee represents the best technology available (BTA) to minimize adverse environmental impacts in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326).

WASHINGTON COUNTY

PowerSouth Energy Cooperative, PO Box 550, Andalusia, AL 36420, NPDES Permit Number AL0054950, located at 7115 Highway 43, McIntosh, AL 36553, for reissuance of a permit, which authorizes discharges resulting from storm water runoff from areas associated with industrial activity through DSN003, DSN004, and DSN006; and storm water runoff from areas associated with industrial activity and DSN05A and DSN05B through DSN005; and stormwater from petroleum storage and handling areas and maintenance areas treated by oil/water separation through DSN05A; and non-contact cooling water and cooling tower blowdown through DSN05B to Bilbo Creek, classified as Swimming and Fish & Wildlife, in the Lower Tombigbee River Basin. The cooling water intake structure the facility uses is subject to 316(b) requirements; however, there requirements are being met by BASF Corporation (AL0003093) and will continue to be evaluated during each subsequent reissuance of that permit.

Imerys Refractory Minerals USA, Inc. – Griffin-Hartzog, 377 Highway 131, Eufaula, Alabama 36072, NPDES Permit Number AL0082821, located on County Road 12 and Edgefield Road, Clayton, Barbour County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation bauxitic and kaolin clay mine, and associated areas, discharging to unnamed tributaries to Hamm Creek, classified as Fish and Wildlife, in the Choctawhatchee River Basin.

BLOUNT COUNTY

Whitaker Contracting Corp. – Summit Limestone Quarry, PO Box 306, Guntersville, Alabama 35976, NPDES Permit Number AL0075663, located at 2335 Hinds Road, Blountsville, Blount County, Alabama, for issuance of a permit that limits discharges of treated drainage from a wet and dry preparation limestone quarry and associated areas, discharging to an unnamed tributary to Browns Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

DALLAS COUNTY

JEFFERSON COUNTY

Best Coal, Inc. – Sloan Mountain Mine, 9865 Highway 269, Parrish, Alabama 35580, NPDES Permit Number AL0073067, located at 2566 Warrior Jasper Road, Warrior, Jefferson County, Alabama, for reissuance and modification of a permit that limits discharges of treated drainage from a dry preparation coal mining operation and associated areas, discharging to Locust Fork, classified as Swimming and Other Whole Body Water-Contact Sports and Fish and Wildlife and to unnamed tributaries to Locust Fork, classified as Fish and Wildlife, in the Black Warrior River Basin.

MARSHALL COUNTY

Urban Oil & Gas Group, LLC - Dorroh Facility, 1000 E 14th Street, Suite 300, Plano, Texas 75074, NPDES Permit Number AL0057363, located at 16030 Romulus Road, Buhl, Tuscaloosa County, Alabama, for issuance of a permit that limits discharges of treated drainage from coalbed methane exploration, production, and associated areas, discharging to the Black Warrior River, classified as Fish and Wildlife, in Black Warrior River Basin.

Jacksonville Water Works, Gas and Sewer Board, 330 Church Avenue SE, Jacksonville, AL 36265, NPDES Permit Number AL0022586, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from Jacksonville WWTP, 655 Nisbet Street NW, Jacksonville, AL 36265, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to UT to Tallasseehatchee Creek, classified as Fish and Wildlife, in the Coosa River Basin. The subject permit also regulates the discharge of storm water runoff to UT to Tallasseehatchee Creek, classified as Fish & Wildlife, in the Coosa River Basin.

COVINGTON COUNTY

Utilities Board of the City of Opp, PO Box 610, Opp, AL 36467, NPDES Permit Number AL0054313, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Opp Westside WWTF, 105 Pittman Road, Opp, AL 36467, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto Lightwood Knot Creek, which is classified as Fish and Wildlife, in the Perdido - Escambia River Basin.

CULLMAN COUNTY

City of Cullman, PO Box 278, Cullman, AL 35056, NPDES Permit Number AL0050423, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from Cullman WWTP, 1437 Welti Road, Cullman, AL 35056, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Eight Mile Creek, classified as Fish and Wildlife, in the Black Warrior River Basin. The subject permit also regulates the discharge of storm water runoff to Ryan Creek, classified as Fish & Wildlife, in the Black Warrior River Basin.

ELMORE COUNTY

Town of Eclectic, 507 Main Street, Eclectic, AL 36024, NPDES Permit Number AL0067903, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Eclectic Lagoon and Sprayfield, 700 North College Avenue, Eclectic, AL 36024, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to a sprayfield in the Tallapoosa River Basin. The facility is located in the drainage basin of Tumkehatchee Creek, which is classified as Fish and Wildlife in the Tallapoosa River Basin.

ESCAMBIA COUNTY

Town of Flomaton, PO Box 632, Flomaton, AL 36441, NPDES Permit Number AL0023493, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Flomaton Lagoon, 662 Martin Luther King Drive, Flomaton, AL  36441, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto Big Escambia Creek, which is classified as Fish and Wildlife in the Escambia River Basin.

FRANKLIN COUNTY

Mosses Water, Sewer, and Fire Protection Authority, 1574 Main Street, Hayneville, AL  36040, NPDES Permit Number AL0055883, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Mosses Wastewater Treatment Facility, 100 Claudie Drive Hayneville, AL  36040, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto an unnamed tributary to Big Swamp Creek, which is classified as Fish and Wildlife in the Alabama River Basin.

MOBILE COUNTY

MONTGOMERY COUNTY

Clearwater Solutions, LLC, 2178 Moores Mill Road, Auburn, AL  36830, NPDES Permit Number AL0051403, for reissuance of a permit which limits the discharge of pollutants from treated domestic from the Red Eagle Honor Farm, 1290 Red Eagle Road Montgomery, AL  36110, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto the Tallapoosa River, which is classified as Fish and Wildlife, in the Tallapoosa River Basin.

PICKENS COUNTY

U.S. Army Corps of Engineers Tenn-Tom Waterway, 5000 N. Jones Trust, PO Box 563, Pell City, AL  35125, NPDES Permit Number AL0084442, for initial issuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Riverside Water Reclamation Facility, 100 Marina Street, Riverside, AL  35135, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto the Coosa River (Logan Martin Lake), which is classified as Swimming/Fish & Wildlife, in the Coosa River Basin.

WALKER COUNTY

The Water Works and Sewer Board of the Town of Parrish, PO Box 730, Parrish, AL 35580, NPDES Permit Number AL0061158, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Parrish HCR Lagoon, 2557 Oakman Parrish Road, Parrish, AL 35580, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Lost Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period. 

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
