NOTICE OF PROPOSED MODIFICATION OF A CONSTRUCTION/DEMOLITION WASTE LANDFILL PERMIT UNDER THE ALABAMA SOLID WASTES AND RECYCLABLE MATERIALS MANAGEMENT ACT AND REQUEST FOR COMMENTS

Chambers County

Amwaste, LLC, a division of Matter Management Enterprises, LLC, on behalf of Chambers County Landfill, LLC submitted to the Alabama Department of Environmental Management (ADEM) a request to modify the solid waste disposal facility permit for the Chambers County C&D Landfill. On March 24, 2021, by Resolution, the Chambers County Commission granted approval to handle and dispose of industrial waste from the existing service area, and to increase the existing permitted daily volume for the Chambers County C&D Landfill. The proposed modification would include converting the facility from a construction and demolition landfill to an industrial landfill. The modification would also increase the allowable daily volume from 75 tons per day to 2,500 tons per day. All other permit conditions will remain the same.

The waste stream for the Chambers County C&D Landfill would remain non-putrescible and non-hazardous construction and demolition waste, yard debris, tires and rubbish as defined by ADEM Rule 335-13-1-.03 in addition to waste from fiberglass manufacturing process waste, off-spec fiberglass insulation, and process waste from process equipment cleanout generated during the manufacture of fiberglass insulation from Knauf Insulation Plant in Lanett, Alabama.  The service area for the Chambers County Landfill, LLC would remain the states of Alabama and Georgia.  The maximum average daily volume of waste disposed at the Chambers County C&D Landfill would increase from 75 tons a day to 2,500 tons a day.

The landfill is located in the Northeast ¼ of the Southeast ¼ and the Southeast ¼ of the Northeast ¼ of Section 36, Township 22 North, Range 27 East in Chambers County, Alabama. The permitted facility consists of approximately 50.48 acres with 19.59 acres for disposal operations.
Copies of the public notice and proposed permit are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt and the complete application is available at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm by appointment.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing or by email, to the Department's named contact above within 35 days following the publication date of this notice.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 35-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Solid Wastes & Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Notice will be sent to any person requesting notice of the final action.
