NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:
Industrial Facilities
BALDWIN COUNTY
Safe Harbour Seafood Inc., 5822 Heritage Circle, Bon Secour, AL 36511, NPDES Permit Number AL0049638, located at the same address, for reissuance of a permit which authorizes discharges resulting from screened washdown water from seafood packing and freezing operations; and cooler water, through DSN001 to Bon Secour River, classified as Swimming/Fish & Wildlife, in the Mobile River Basin; and discharge of water from loading and unloading of seafood, through DSN002 to Bon Secour River, classified as Fish & Wildlife, in the Mobile River Basin.

C&T Sales, LLC, 4625 Hickory Lane, Tuscumbia, AL 35674, NPDES Permit Number AL0065374, located at the same address, for reissuance of a permit which authorizes discharges resulting from stormwater runoff associated with lumber and wood products industry, including wood treating operations using copper azole type C preservative, through DSN001 and DSN002 to an unnamed tributary to Dobson Branch, classified as Fish & Wildlife, in the Tennessee River Basin.
JEFFERSON COUNTY
City of Birmingham - Eastern Area Landfill, 501 6th Avenue South, Birmingham, AL 35205, NPDES Permit Number AL0055247, located at 2787 Alton Drive, Birmingham, AL 35210, for reissuance of a permit which authorizes discharges resulting from storm water runoff not containing leachate from municipal landfill site, through DSN001, DSN002, DSN003, and DSN006 to an unnamed tributary to Stinking Creek, classified as Fish & Wildlife, in the Cahaba River Basin; storm water runoff associated with diesel storage and storm water runoff not containing leachate from municipal landfill site, through DSN004 to Pinchgut Creek, classified as Fish & Wildlife, in the Cahaba River Basin; and storm water runoff not containing leachate from municipal landfill site, through DSN005 to Pinchgut Creek, classified as Fish & Wildlife, in the Cahaba River Basin.

INEOS Styrolution America LLC, PO Box 5460, Decatur, AL 35602, NPDES Permit Number AL0064840, located at 950 Nova Chemicals Blvd, Decatur, AL 35601, for reissuance of a permit which authorizes discharges resulting from storm water runoff from polystyrene manufacturing facility, through DSN001 and DSN002 to Betty Rye Branch, classified as Fish & Wildlife, in the Tennessee River Basin.
SUMTER COUNTY
Arcosa LW BR, LLC. - Livingston, P.O. Drawer V, Livingston, AL 35470, NPDES Permit Number AL0083526, located at 201 South Industrial Park Road, Livingston, AL 35470, for reissuance of a permit which authorizes discharges resulting from storm water associated with the manufacture of lightweight aggregate, through DSN001 to an unnamed tributary to the Sucarnoochee River, classified as Fish & Wildlife, in the Tombigbee River Basin; and storm water and non-contact cooling water associated with the manufacture of lightweight aggregate, through DSN002 to an unnamed tributary to the Sucarnoochee River, classified as Fish & Wildlife, in the Tombigbee River Basin. The cooling water intake structure used by the Permittee has been evaluated using available information. At this time, the Department has determined that the cooling water intake structure represents the best technology available (BTA) to minimize adverse environmental impact in accordance with Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326).

COLBERT COUNTY
Colbert County Rural Water System, 2750 Highway 20, Tuscumbia, AL 35674, NPDES Permit Number AL0075515, for reissuance of a permit which limits the discharge of pollutants from filter backwash from Colbert County WTP, 16531 Highway 72, Tuscumbia, AL 35674, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of filter backwash to the Tennessee River (Pickwick Lake) which is classified as Public Water Supply, Swimming and Other Whole Body Water-Contact Sports, and Fish and Wildlife, in the Tennessee River Basin.
LAUDERDALE COUNTY
Town of Anderson, PO Box 8, Anderson, AL 35610, NPDES Permit Number AL0047929, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Town of Anderson WWTP, 200 Bayless Street, Anderson, AL 35610, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Anderson Creek, classified as Fish and Wildlife, in the Tennessee River Basin.
MACON COUNTY
Town of Shorter, PO Box 117, Shorter, AL 36075, NPDES Permit Number AL0076317, for reissuance of a permit which limits the discharge of pollutants from treated domestic from the Shorter WWTF, 796 Halla Bama Drive, Shorter, AL 36075, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to a Sprayfield in the Tallapoosa River Basin.
MADISON COUNTY
Living Waters Utilities, LLC, 160 Piper Lane, Alabaster, AL 35007, NPDES Permit Number AL0070467, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Madison County High School WWTP, 174 Brock Road, Brownsboro, AL 35741, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Flint River, classified as Fish and Wildlife, in the Tennessee River Basin.
RUSSELL COUNTY
Russell County Board of Education, PO Box 400, Phenix City, AL 36868, NPDES Permit Number AL0073750, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Russell County Middle School, 4699 Old Seale Highway, Seale, Alabama 36875, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to a Sprayfield in the Chattahoochee River Basin. The facility is in the drainage basin of Cowpen Creek, a waterway classified as Fish and Wildlife, in the Chattahoochee River Basin.
TALLAPOOSA COUNTY
City of Alexander City, PO Box 552, Alexander City, AL 35011, NPDES Permit Number AL0048861, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater, and stormwater runoff from Sugar Creek Advanced WWTP, 2515 Sugar Creek Road, Alexander City, AL 35010, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to Sugar Creek and Tallapoosa River (Lake Martin), which is classified as Swimming, and Fish and Wildlife, in the Tallapoosa River Basin.
The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations; and for those in the coastal area, are consistent with the Alabama Coastal Management Program.
Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.
A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.
After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record. The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.
