PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Process Equipment, Inc. DBA Process Barron (EPA Identification Number AL0000028811), which operates an industrial fan manufacturing and repair facility located at 2770 Welborn Street in Pelham, Shelby County, Alabama.

The violations consisted of the following: offering hazardous waste to a facility that is not a designated facility or otherwise authorized to receive hazardous waste, failure to make a proper waste determination, failure to mark or label satellite accumulation containers with the words “Hazardous Waste”, failure to mark or label satellite accumulation containers with an indication of the hazards of the contents, failure to mark or label containers of hazardous waste with the words “Hazardous Waste”, failure to mark or label containers of hazardous waste with an indication of the hazards of the contents, failure to mark or label containers of hazardous waste with an accumulation start date, failure to submit ADEM Form 8700-12 to the Department annually, and failure to prepare a uniform hazardous waste manifest for each shipment of hazardous waste.

The Department is proposing a civil penalty in the amount of $13,000. The Order, if issued, would require Process Equipment, Inc. DBA Process Barron to comply with all applicable requirements of Division 14 of the ADEM Administrative Code.

The comment period shall end at the close of business 30 days from the publication date of this notice.
