PROPOSED ORDER
Madison County
Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Advanced Technical Finishing, LLC (EPA Identification Number ALD059903641), which owns/operates an electroplating and metal finishing facility located at 1003 Orchard Street Northwest in Huntsville, Madison County, Alabama.
The violations consisted of the following: failure to prevent unknowing entry into the central accumulation area, failure to post No Smoking" signs wherever there is a hazard from ignitable or reactive waste, failure to post "Danger--Unauthorized Personnel Keep Out" signs at each entrance to the central accumulation area, failure to mark containers with the words “Hazardous Waste”, failure to mark containers with an indication of the hazards of the contents, failure to mark containers with an accumulation start date, failure to submit a correct and complete ADEM Form 8700-12 annually, failure to maintain copies of all signed returned to generator manifests, failure to conduct weekly inspections of all hazardous waste accumulation areas, failure to ensure that personnel complete required training before handling hazardous waste, failure to provide a waste minimization plan for review, failure to update the emergency contact list, failure to submit a copy of the contingency plan to local emergency responders, failure to maintain the job title for each position and the name of the employee filling each job, failure to maintain a written job description for each position that handles hazardous waste, and failure to maintain a written description of the type and amount of training needed.
The Department is proposing a civil penalty in the amount of $9,600. The Order, if issued, would require Advanced Technical Finishing, LLC to comply with all applicable requirements of Division 14 of the ADEM Administrative Code.
Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention Stephen A. Cobb, Chief of the Land Division, P.O. Box 301463, Montgomery, Alabama 36130-1463. The comment period shall end at the close of business 30 days from the publication date of this notice. A nominal fee for copying may be charged.
