NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

BALDWIN COUNTY

Baldwin County Commission – Magnolia Sanitary Landfill, 312 Courthouse Square Suite 12, Bay Minette, AL 36507, NPDES Permit Number AL0069345, located at 15140 County Road 49, Summerdale, AL 36580, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff that contains landfill wastewater as defined by 40 CFR 445 through DSN001 to an unnamed tributary to Barner Branch, classified as Fish & Wildlife, in the Mobile River Basin.

CONECUH COUNTY

GreenPoint Ag Holdings, LLC, 121-B Somerville Road, Decatur, AL 35601, NPDES Permit Number AL0080659, located at 400 Miller Sellers Dr, Evergreen, AL 36401, for reissuance of a permit, which authorizes discharges resulting from stormwater associated with fertilizer blending and bagging through DSN001 to an unnamed tributary to Murder Creek, classified as Fish & Wildlife, in the Conecuh River Basin.

COVINGTON COUNTY

PowerSouth Energy Cooperative - Lowman Energy Center, Post Office Box 550, Andalusia, Alabama, 36420, NPDES Permit Number AL0003671, located at 4392 Carson Road, Leroy, Alabama, 36548, for reissuance of a permit, which authorizes discharges resulting from discharges from the process waste pond including sanitary wastewaters (DSN02C), stormwater runoff pond (DSN02D), cooling tower blowdown (DSN02E), low volume wastes (DSN02F), chemical metal cleaning wastes (DSN02G), stormwater discharges from petroleum storage areas (DSN02H), miscellaneous cooling waters, waters associated with groundwater remediation, fire protection system waters, and stormwater runoff associated with electric power generation discharging through Outfall DSN002 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin; stormwater runoff associated with power plant operations and fire protection system waters discharging through Outfall DSN003 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin; intake screen backwash waters discharging through Outfall DSN004 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin; discharges from the CCR impoundment wastewater treatment system including wastewaters associated with dewatering and decanting activities and stormwater runoff discharging through Outfall DSN006 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin; stormwater runoff associated with electric power generation and fire protection system waters discharging through Outfalls DSN007, DSN008, DSN009, DSN010, DSN011, DSN012, DSN013, and DSN014 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin; stormwater runoff associated with electric power generation including stormwater discharges from the transformer secondary containment basin and fire protection system waters discharging through Outfall DSN015 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin; stormwater runoff, river silt dewatering waters associated with dredging activities, and fire protection system waters discharging through Outfalls DSN016 and DSN017 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin; stormwater runoff from the capped CCR impoundment footprint discharging through Outfalls DSN018, DSN019, DSN020, DSN021, DSN022, DSN023, and DSN024 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin; and fire protection system waters discharging through Outfall DSN025 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin.  At this time, the Department has determined that the cooling water intake structure represents the best technology available (BTA) to minimize adverse environmental impact in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C. section 1326).

ESCAMBIA COUNTY

TR Miller Mill Company Inc, PO Box 708, Brewton, AL 36427, NPDES Permit Number AL0000779, located at 215 Deer St, Brewton, AL 36426, for reissuance of a permit, which authorizes discharges resulting from treated process wastewater and treated groundwater through DSN002 to Murder Creek, classified as Fish & Wildlife, in the Escambia River Basin; and storm water associated with lumber and wood products industry including wood treating operations using preservatives containing copper, chromium, and arsenic, creosote, and chlorophenolic formulations through DSN003 to an unnamed tributary to Murder Creek, classified as Fish & Wildlife, in the Escambia River Basin.

JACKSON COUNTY

Justice Coal of Alabama, LLC – Crane Central Mine, 302 South Jefferson Street, Roanoke, Virginia 24011, NPDES Permit Number AL0080071, located at County Road 693, Flat Rock, Jackson County, Alabama, for issuance of a permit that limits discharges from a wet and dry preparation coal mining operation and associated areas, discharging to unnamed tributaries to Long Island Creek, Long Creek, unnamed tributaries to Long Creek, Ladd Creek, unnamed tributaries to Ladd Creek, Indian Creek, and unnamed tributaries to Indian Creek, all classified as Fish and Wildlife, in the Tennessee River Basin.

Justice Coal of Alabama, LLC – Glade Preparation Plant, 302 South Jefferson Street, Roanoke, Virginia 24011, NPDES Permit Number AL0073962, located at County Road 464, Pisgah, Jackson County, Alabama, for issuance of a permit that limits discharges from a dry and wet preparation coal mining operations and associated areas, discharging to Big Glade Branch, Pond Creek, and Flat Rock Creek, all classified as Fish and Wildlife, in the Tennessee River Basin.

CULLMAN COUNTY

Town of Dodge City, 130 Howard Circle, Hanceville, AL  35077, NPDES Permit Number AL0080870, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Dodge City WWTP, County Road 223, Hanceville, AL  35077 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Pewterfork Creek, classified as Fish & Wildlife, in the Black Warrior River Basin.

MONTGOMERY COUNTY

Pintlala Water Authority, 123 Federal Road, Hope Hull, Alabama 36043, NPDES Permit Number AL0069884, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Stewart-McLean Lagoon, U.S. Highway 31 & McLean Road, Montgomery, AL 36043, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to an unnamed tributary to Pintlala Creek, a waterway classified as Fish & Wildlife, in the Alabama River Basin.

TALLADEGA COUNTY

Sycamore Water and Sewer Authority, PO Box 310, Sycamore, Alabama 35149, NPDES Permit Number AL0061573, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Sycamore WWTP, 210 Machen Road, Sycamore, AL 35149, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Foreman Branch, a waterway classified as Fish & Wildlife, in the Coosa River Basin.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period. 

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
