Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-16 (2006 Rplc. Vol.), the Alabama Department of Environmental Management is proposing to issue a Consent Order to Alabama Power Company, the owner/operator of an electric steam generating facility currently operating in Bucks, Mobile County, Alabama.

The violation consisted of an exceedance of an applicable HCl emissions limitation contained in Major Source Operating Permit No. 503-1001 and 40 CFR Part 63, Subpart UUUUU. Testing conducted on Unit 4 at the Barry Steam Electric Generating Plant on August 4, 2021 in accordance with Method 26 of 40 CFR 60, Appendix A showed the measured HCl emissions rate exceeding the applicable HCl emissions limitation, in violation of Major Source Operating Permit No. 503-1001.

The Department is proposing a civil penalty in the amount of $75,000.  The Order, if issued, would require Alabama Power Company to operate in compliance with ADEM Admin. Code 335-3 and all conditions and requirements of Major Source Operating Permit No. 503-1001 and applicable Air Permits that have been issued to Alabama Power Company - Plant Barry.
