NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE
INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS


The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

COLBERT COUNTY

Cherokee Nitrogen, LLC, 1080 Industrial Drive, Cherokee, Alabama 35616-5414, NPDES Permit Number AL0000418, located at the same address, for reissuance of a permit, which authorizes discharges resulting from non-contact cooling water, stormwater runoff, and Internal Outfall DSN01A which includes process wastewater discharges associated with the production of ammonia, nitric acid, urea, and ammonium nitrate including sanitary wastewaters, boiler blowdown, water filter backwash, cooling tower blowdown, and stormwater runoff discharging through Outfall DSN001 into an unnamed tributary to the Tennessee River classified as Fish & Wildlife, in the Tennessee River Basin. The thermal component of the discharge is subject to proposed effluent limitations under CWA section 301 or 306. The Permittee has filed a request for a thermal variance established under Section 316(a) of the Federal Clean Water Act (33 U.S.C. section 1326) which provides for alternative limitations for the thermal discharges. At this time, the Department has proposed thermal limitations of 98.0oF applied as a monthly average and 100.0oF applied as a daily maximum as established in the proposed 316(a) thermal variance. At this time, the Department, based on review of site-specific data submitted under 40 CFR 122.21(r), has concluded that the documented rate of impingement at the cooling water intake is so low that no additional controls are warranted. The Department has made a Best Professional Judgment (BPJ) determination that the cooling water intake structure represents the best technology available (BTA) to minimize adverse environmental impacts in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326).

Lumber One Wood Preserving LLC, 755 West 20th Avenue, Sheffield, Alabama 35660, NPDES Permit Number AL0065129, located at the same address, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff associated with wood preserving operations and remanufacturing of wood products discharging through Outfalls DSN001, DSN002, DSN003, and DSN004 into an Unnamed Tributary of the Tennessee River, classified as Fish and Wildlife, in the Tennessee River Basin.

DALE COUNTY

Arichem LLC, 187 Sloss Industrial Rd, Ariton, AL 36311, NPDES Permit Number AL0066770, located at the same address, for reissuance of a permit, which authorizes discharges resulting from Storm water runoff from industrial activities, through DSN001 into Unnamed Tributary to Bear Creek, classified as Fish & Wildlife, in the Choctawhatchee River Basin.

FAYETTE COUNTY

Interfor U.S. Inc., Fayette Division, 545 County Road 6, Belk, Alabama 35545, NPDES Permit Number AL0083798, located at the same address, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff associated with the lumber, wood, and paper products industry discharging through Outfalls DSN001, DSN002, DSN003, DSN005, DSN007, and DSN008 into an Unnamed Tributary to Luxapallila Creek classified as Fish & Wildlife, in the Upper Tombigbee River Basin; maintenance wash waters, equipment wash waters, and stormwater runoff associated with the lumber, wood, and paper products industry including petroleum storage and handling areas discharging through Outfall DSN004 into an Unnamed Tributary to Luxapallila Creek classified as Fish & Wildlife, in the Upper Tombigbee River Basin; process waters from wet decking operations and stormwater runoff associated with the lumber, wood, and paper products industry discharging through Outfall DSN006 into an Unnamed Tributary to Luxapallila Creek classified as Fish & Wildlife, in the Upper Tombigbee River Basin.

MARION COUNTY

3M Company - 3M Guin, 6675 US Hwy 43, Guin, Alabama 35563, NPDES Permit Number AL0084417, located at the same address, for initial issuance of a permit, which authorizes discharges from stormwater runoff associated with the production of reflective sheeting, pavement marking tape, and glass bubbles including air handler condensate, groundwater infiltration, and stormwater from tank farm secondary containment areas discharging through Outfall DSN001 to Purgatory Creek, classified as Public Water Supply and Fish & Wildlife, in the Tombigbee River Basin; discharges from stormwater runoff associated with the production of reflective sheeting, pavement marking tape, and glass bubbles including air handler condensate and groundwater infiltration discharging through Outfall DSN002 to Purgatory Creek, classified as Public Water Supply and Fish & Wildlife, in the Tombigbee River Basin.

3M Guin Landfill, 6675 US Hwy 43, Guin, Alabama 35563, NPDES Permit Number AL0084425, located at County Road 83, Guin, Alabama 35563, for initial issuance of a permit, which authorizes discharges from stormwater runoff associated with an industrial landfill discharging through Outfalls DSN001 and DSN002 into an Unnamed Tributary to Luxapallila Creek, classified as Fish & Wildlife, in the Tombigbee River Basin.

SUMTER COUNTY

All outfalls are located in the Upper Tombigbee River Basin.

WALKER COUNTY

Marigold Works, LLC., 200 18th Ave SW, Jasper, AL 35501, NPDES Permit Number AL0083721, located at the same address, for reissuance of a permit, which authorizes discharges resulting from equipment washdown water and stormwater associated with heavy equipment manufacturing through DSN001 to Tanyard Creek which is classified as Fish & Wildlife, and stormwater associated with heavy equipment manufacturing (material and parts storage) through DSN002 to Tanyard Creek which is classified as Fish & Wildlife, and stormwater associated with heavy equipment manufacturing (saw shop and material storage) through DSN003 to Tanyard Creek which is classified as Fish & Wildlife, and stormwater associated with heavy equipment manufacturing (office building and maintenance shop) through DSN004 to Tanyard Creek which is classified as Fish & Wildlife, and stormwater from roof drains (CNC building) through DSN005 to Tanyard Creek which is classified Fish & Wildlife. Nelson Brothers, LLC-Parrish Facility, 820 Shades Creek Parkway, Suite 2000, Birmingham, AL 35209, NPDES Permit Number AL0066265, located at 500 Old Baltimore Road, Parrish, AL 35580, for reissuance of a permit, which authorizes discharges resulting from boiler blowdown, air compressor condensate, steam tracing condensate, dike area wash water and stormwater associated with the manufacture of fuel blends and specialty chemicals including precursors used in the manufacture of blasting agents through DSN001 to an unnamed tributary to Bryants Creek which is classified as Fish & Wildlife, and air compressor condensate and stormwater associated with warehouse, parking and laydown yard through DSN003 to an unnamed tributary to Indian Creek which is classified as Fish & Wildlife. Both outfalls are located in the Black Warrior River Basin.

Lhoist North America of Alabama, LLC – Brierfield Quarry, 7444 Highway 25, Brierfield, Alabama 35035, NPDES Permit Number AL0067831, located 14786 Montevallo Road, Brierfield, Bibb County, Alabama, for reissuance and modification of a permit that limits discharges of treated drainage from a wet and dry preparation, crushed and broken limestone quarry and associated areas, discharging to Mahan Creek, classified as Fish and Wildlife, in the Cahaba River Basin.

DALLAS COUNTY

Henry Brick Company, Inc. – Faulk Mine, PO Box 850, Selma, Alabama 36702, NPDES Permit Number AL0054909, located on County Road 316, Selma, Dallas County, Alabama, for issuance of a permit that limits discharges of treated drainage from a shale and/or common clay mine and associated areas, discharging to unnamed tributaries to Beech Creek, classified as Fish and Wildlife, in the Alabama River Basin.

Asphalt Contractors, Inc. – Oakmulgee Pit, PO Box 241447, Montgomery, AL 36124 , NPDES Permit Number AL0058548, located on County Road 210, Selma, Dallas and Perry Counties, Alabama, for issuance of a permit that limits discharges of treated drainage from a construction sand and gravel mine and associated areas, discharging to Groundwater, Oakmulgee Creek, classified as Swimming and Other Whole Body Water-Contact Sports, and to an unnamed tributary to Oakmulgee Creek, classified as Fish and Wildlife, in the Cahaba River Basin.

TUSCALOOSA COUNTY

Southland Resources, Inc. – Swann’s Crossing, PO Box 770, Cottondale, Alabama 35453, NPDES Permit Number AL0080578, located at 14166 Lock 17 Road, Brookwood, Tuscaloosa County, Alabama, for issuance of a permit that limits discharges of treated drainage from a wet and dry preparation coal mining operation and associated areas, discharging to unnamed tributaries to Daniel Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

City of Attalla, 612 Fourth Street NW, Attalla, AL 35954, NPDES Permit Number AL0057657, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from Attalla Wastewater Treatment Lagoon, 4000 East Greenview Avenue, Rainbow City, AL 35906, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Coosa River (Neely Henry Lake), classified as Fish and Wildlife, in the Coosa River Basin.

LAUDERDALE COUNTY

Alabama Department of Conservation and Natural Resources and Rogersville Water Works and Sewer Board, 64 North Union Street Room 483, Montgomery, AL 36104, NPDES Permit Number AL0032387, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Joe Wheeler State Park and Rogersville Lagoon, 4218 McLean Drive, Rogersville, AL 35652, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Tennessee River (Wheeler Lake), classified as Fish and Wildlife, Swimming and Public Water Supply in the Tennessee River Basin.

PIKE COUNTY

Suntrace Troy, LLC., 12689 US Highway 231, Lot 52, Troy, AL 36081, NPDES Permit Number AL0057509, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Suntrace Troy, LLC, 12689 US Highway 231, Troy, AL 36081, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to an unnamed tributary to Walnut Creek which is classified as Fish and Wildlife in the Choctawhatchee River Basin.

ST CLAIR COUNTY

City of Springville, PO Box 919, Springville, AL 35146, NPDES Permit Number AL0050903, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and stormwater runoff from Springville Water Reclamation Facility, Alabama Highway 174, Springville, AL 35146, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to Little Canoe Creek, which is classified as Fish & Wildlife, in the Coosa River Basin.

TALLAPOOSA COUNTY

City of Alexander City, PO Box 552, Alexander City, AL 35011, NPDES Permit Number AL0021156, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater, and stormwater runoff from Coley Creek WWTP, 2150 Coley Creek Road, Alexander City, AL 35010, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to Coley Creek (Lake Martin), which is classified as Public Water Supply, Swimming, and Fish and Wildlife, in the Tallapoosa River Basin.


The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations; and for those in the coastal area, are consistent with the Alabama Coastal Management Program.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record. The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.
