NOTICE OF PROPOSED UNILATERAL ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Unilateral Order to the Town of Lexington/Lexington Lagoon and Sprayfield, NPDES Permit Number AL0072834, located on County Road 497, Lexington, Lauderdale County, Alabama.

The violations noted in the Unilateral Order consist of effluent permit limitation violations, sanitary sewer overflows (SSOs), and failure to comply with Consent Order 16-083-CWP.

The Department is proposing a civil penalty in the amount of $5,900.00.  The Order, if issued, would require the Town of Lexington to submit an Engineering Report; submit progress reports; complete repairs, rehabilitation, and upgrades to the sprayfield as necessary to reduce the bacteria levels in stormwater runoff from the sprayfield; complete repairs, rehabilitation, and upgrades to the sewer collections system and lift stations as necessary to minimize and mitigate SSOs, submit a certification of compliance, and comply with all Permit conditions.
