PROPOSED CONSENT ORDER

Mobile County

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to New South Lumber Company, the owner/operator of a sawmill facility located in Bucks, Mobile County, Alabama.

The violation consisted of commencing construction of the facility prior to receiving Air Permits.

The Department is proposing a civil penalty in the amount of $15,000. The Order, if issued, would require New South Lumber Company to pay the Alabama Department of Environmental Management within 45 days of the effective date, and comply with the terms, limitations, and conditions of the Permit and ADEM Admin. Code div. 335-3 immediately and continuing every day thereafter.

The comment period shall end at the close of business 30 days from the publication date of this notice.
