NOTICE OF A PROPOSED INDUSTRIAL WASTE LANDFILL PERMIT MODIFICATION UNDER
THE ALABAMA SOLID WASTES & RECYCLABLE MATERIALS MANAGEMENT ACT AND REQUEST
FOR COMMENTS

Mobile County

Southern Earth Sciences, Inc. has submitted to the Alabama Department of Environmental Management (ADEM), on behalf of Dirt, Inc., an application for modification of the Solid Waste Disposal Facility Permit for Dirt, Inc. Schillinger’s Road Landfill (Pit #1) (Permit No. 27-08). The modification would add blast media/sediment from Austal USA, located in Mobile, AL, and cured resins and waste materials from Fiber Glass Systems, LP, located in Grand Bay, AL, to the approved waste stream. The waste stream for the Dirt, Inc. Schillinger’s Road Landfill (Pit #1) will be non-hazardous, non-putrescible, construction and demolition waste, friable asbestos, tires, yard debris (leaves, limbs, stumps); and nonhazardous industrial waste as approved by the Department. The facility may accept spent black beauty abrasive grit from Alabama Shipyard, LLC (Mobile, AL), off specification hydrophobic treated crushed limestone and off specification crushed limestone from Incoa Performance Minerals, LLC (Theodore, AL.), spent black beauty abrasive blast media from Mobile Area Water and Sewer System (Mobile, AL.), blast media/sediment from Austal USA (Mobile, AL.), and cured resins and fiberglass materials from Fiber Glass Systems, LP (Grand Bay, AL). Special waste approved by the Department may also be accepted. The service area for the Dirt, Inc. Schillinger’s Road Landfill (Pit #1) would remain Mobile, Baldwin and Washington Counties in the State of Alabama; and asbestos waste from the states of Alabama, Florida, Georgia, Mississippi, and Louisiana. The maximum average daily volume of waste disposed at the Dirt, Inc. Schillinger’s Road Landfill (Pit #1) would remain 1200 cubic yards per day. All other permit conditions would remain the same.

The Dirt, Inc. Schillinger’s Road Landfill (Pit #1) is described as being located in part of the SE ¼ of Section 1 and the NE ¼ of Section 12, Township 5 South, Range 3 West, and is more precisely located at 8081 Cottage Hill Road in Mobile County, Alabama. The total permitted area for the facility is approximately 250 acres with 207.16 acres approved for disposal.

Copies of the public notice, the permit application, and proposed permit are available for public inspection electronically via http://www.adem.alabama.gov/newsEvents/publicNotices.cnt and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm by appointment. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 35 days following the publication date of this notice. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 35-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Solid Wastes & Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request. Notice will be sent to any person requesting notice of the final action.
