NOTICE OF A PROPOSED RENEWAL AND MODIFICATION OF A SOLID WASTE DISPOSAL
FACILITY PERMIT UNDER THE ALABAMA SOLID WASTES & RECYCLABLE MATERIALS
MANAGEMENT ACT AND REQUEST FOR COMMENTS

MORGAN COUNTY

The City of Decatur submitted to the Alabama Department of Environmental Management (ADEM) an application to continue to operate a municipal solid waste landfill known as the City of Decatur-Morgan County Sanitary Landfill (Permit No. 52-03). The waste stream for the City of Decatur-Morgan County Sanitary Landfill would remain nonhazardous solid wastes, noninfectious putrescible and nonputrescible wastes including but not limited to household garbage, industrial waste, construction and demolition debris, commercial waste, appliances, tires, trees, limbs, stumps, dried sludge, ashes, paper, special waste and other similar type materials. The service area for the City of Decatur-Morgan County Sanitary Landfill would remain Morgan, Limestone, Madison, Jackson, Marshall, Cullman, Blount, Walker, Winston, Marion, Franklin, Lawrence and Colbert counties in Alabama. Also, the City of Decatur-Morgan County Sanitary Landfill may continue to accept waste from the following counties in Tennessee: Wayne, Lawrence, Giles, Lincoln and Marshall. The permit renewal application requested that all previously approved variances and special conditions be granted in the renewed permit.

As a part of the permit renewal application, the City of Decatur requests to increase the maximum average daily volume of waste accepted for disposal at the City of Decatur-Morgan County Sanitary Landfill. As required by the Code of Alabama §22-27-48, the Decatur City Council on August 7, 2023, and the Morgan Commission on August 8, 2023, approved by resolution to increase the maximum daily volume of waste accepted for disposal at the City of Decatur-Morgan County Sanitary Landfill from 1500 tons per day to 3000 tons per day. Also, the City of Decatur requests to modify the closure plan for the construction and demolition disposal area (Cells 2 through 9).

The City of Decatur-Morgan County Sanitary Landfill is described as being located in Sections 7 and 18, Township 5 South, Range 5 West in Morgan County, Alabama. The total landfill facility area for the City of Decatur-Morgan County Sanitary Landfill would remain 452.59 acres with a disposal area of 264.84 acres.

Copies of the public notice, permit application, and proposed permit are available for public inspection electronically via http://www.adem.alabama.gov/newsEvents/publicNotices.cnt and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm by appointment. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 35 days following the publication date of this notice. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 35-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Solid Wastes & Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request. Notice will be sent to any person requesting notice of the final action.
