PROPOSED CONSENT ORDER

ESCAMBIA COUNTY

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Escambia Operating Company (EOC), the owner/operator of the Big Escambia Creek (BEC) oil and natural gas production and processing facility currently operating in Atmore, Escambia County, Alabama.

The violation consisted of failing to comply with the three-hour and twenty-four hour sulfur dioxide (SO2) emission allowables for the sulfur recovery unit (SRU)/thermal oxidizer.

The Department is proposing a civil penalty in the amount of $160,000.  The Order, if issued, would require Escambia Operating Company to operate in compliance with ADEM Admin. Code 335-3 and all conditions and requirements of applicable Air Permits that have been issued to Escambia Operating Company.

The comment period shall end at the close of business 30 days from the publication date of this notice.  A copy of the proposed Order is available on the ADEM web page at http://adem.alabama.gov/compInfo/adminOrders.cnt, or may be obtained by written request to the above address.  A nominal fee for copying may be charged.
