Notice Requesting Data and Information for Preparation of Alabama’s Draft 2022 Section 303(d) List of Impaired Waters and Comments on Alabama’s Draft Water Assessment and Listing Methodology

Section 303(d) of the Clean Water Act requires that each state identify those waters that do not currently support designated uses and establish a priority ranking of the waters, taking into account the severity of the pollution and the uses to be made of the waters.  For each water on the list, the state is required to establish the total maximum daily load (TMDL) at a level necessary to implement the applicable water quality standards.

At this time, ADEM has begun development of the 2022 Section 303(d) list and is soliciting data and information for consideration during preparation of the list.  Also, the Department is soliciting comments on Alabama’s Water Assessment and Listing Methodology which will be used to develop the 2022 Section 303(d) list.  The methodology has been prepared to assist the Department in the development of the 303(d) list and establishes minimum data requirements and assessment/listing protocols.  In order to be fully considered in this process, persons wishing to offer a submittal should do so in an electronic format.

While the Department will consider all data submitted, we reserve the right to incorporate only those data that meet minimum quality standards.  The Department is not bound by interpretations provided by data submitters.  It should also be noted that the Department is unable to pay a fee for the use of data. Data, information, and comments should be submitted to Joseph Roy, Water Division, Alabama Department of Environmental Management, P.O.
