NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE
INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

COLBERT COUNTY

Constellium Muscle Shoals, LLC, 4805 Second Street, Muscle Shoals, Alabama 35661, NPDES Permit Number AL0000035, located at the same address, for reissuance of a permit which authorizes discharges associated with Alloys Plant pump station #1 overflow, which contains non-contact cooling water, stormwater runoff and groundwater infiltration discharging through Outfall DSN001 to Pond Creek, classified as Agricultural and Industrial Water Supply, in the Tennessee River Basin; Treated process wastewaters and storm water runoff associated with the Alloys Plant, Alabama Reclamation Plant, former Reduction Plant, the Water Treatment Plant, and flow augmentation including internal Outfall 04A (discharges of treated coil coating wastewaters from the Alloys Plant Chromium Treatment System), internal Outfall 04E (wastewaters associated with black dross washing and direct chill casting operations including cooling waters, and stormwater runoff), and internal Outfall 04F (wastewaters associated with hot rolling, cold rolling, electromagnetic casting, coil coating, and cleaning or etching rinse including sanitary wastewaters, cooling waters, wash waters, discharges from Oily Waste Treatment Plants #1 and #2, and stormwater runoff) discharging through Outfall DSN004 to Pond Creek, classified as Agricultural and Industrial Water Supply, in the Tennessee River Basin; Stormwater runoff associated with the northwest portion of the Alabama Reclamation Plant site discharging through Outfall DSN006 to Pond Creek, classified as Agricultural and Industrial Water Supply, in the Tennessee River Basin; Outfall DSN 004 bypass including treated process wastewaters and storm water runoff associated with the Alloys Plant, Alabama Reclamation Plant, former Reduction Plant, the Water Treatment Plant, and flow augmentation including internal Outfall 04A (discharges of treated coil coating wastewaters from the Alloys Plant Chromium Treatment System), internal Outfall 04E (wastewaters associated with black dross washing and direct chill casting operations including cooling waters, and stormwater runoff), and internal Outfall 04F (wastewaters associated with hot rolling, cold rolling, electromagnetic casting, coil coating, and cleaning or etching rinse including sanitary wastewaters, cooling waters, wash waters, discharges from Oily Waste Treatment Plants #1 and #2, and stormwater runoff) discharging through Outfall DSN007 to Pond Creek, classified as Agricultural and Industrial Water Supply, in the Tennessee River Basin. The Department has determined that the CWIS represents the best technology available (40 CFR 125.98(b)(6)) to minimize adverse environmental impact in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C. section 1326).

MARSHALL COUNTY

Pilgrim’s Pride Corporation, Guntersville Processing Plant, 3500 Lake Guntersville Park Drive, Guntersville, Alabama 25976, NPDES Permit Number AL0082384, located at the same address, for reissuance a permit which authorizes discharges resulting from stormwater runoff associated with poultry processing, discharging through Outfalls DSN001Q, DSN004Q, and DSN005Q to Big Spring Creek (Guntersville Lake), classified as Public Water Supply, Swimming, and Fish and Wildlife, in the Tennessee River Basin.

MORGAN COUNTY

Terral RiverService LLC, 4402 East Main Street, Blytheville Arkansas 72315, NPDES Permit Number AL0084131, located on a barge anchored on the south bank of the Tennessee River at approximately river mile 297.3, Independence Avenue, Decatur, Alabama, 35601, for modification of a permit which authorizes discharges associated with barge washing operations of barges having contained cargoes listed in the permit application discharging through Outfall DSN001 to the Tennessee River, classified as Swimming, Fish & Wildlife, in the Tennessee River Basin.

BARBOUR COUNTY

Imerys Refractory Minerals USA, Inc. – H Hartzog Pit 4 & 7, 377 Highway 131 Eufaula, Alabama 36072 NPDES Permit Number AL0083801, located at 243 County Road 67, Clayton, Barbour County, Alabama, for issuance of a permit that limits discharges of treated drainage from a bauxitic and kaolin clay mine and associated areas, discharging to Hamm Creek, classified as Fish and Wildlife, in the Choctawhatchee River Basin.

BIBB COUNTY

Henry Brick Company, Inc. – Henry Brick Shale Operations, PO Box 850, Selma, Alabama 36702 NPDES Permit Number AL0057576, located on County Road 2, Brierfield, Bibb County, Alabama, for issuance of a permit that limits discharges of treated drainage from a shale and/or common clay mine and associated areas, discharging to an unnamed tributary to Splawn Branch, classified as Fish & Wildlife, in the Cahaba River Basin.

COLBERT COUNTY

BWI MTN II Inc. d/b/a Blue Water Industries - Allsboro Quarry - 831 Needham Drive, Smyrna, Tennessee 37167, NPDES Permit Number AL0040894, located at 96 State Line Road, Cherokee, Colbert County, Alabama, for issuance of a permit that limits discharges of treated drainage from a wet and dry preparation crushed and broken limestone quarry and associated area, discharging to an unnamed tributary to Cripple Deer Creek and Cripple Deer Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

ESCAMBIA COUNTY

Vulcan Construction Materials, LLC - Atmore Sand and Gravel - 1200 Urban Center Drive, Birmingham, Alabama 35242, NPDES Permit Number AL0059498, located at 1090 Old Jack Springs Road, Atmore, Escambia County, Alabama, for issuance of a permit that limits discharges of treated drainage from a wet preparation construction sand and gravel mine and associated areas, discharging to an unnamed tributary to Sizemore Creek, classified as Fish and Wildlife, in the Conecuh River Basin.

Mays Mining, Inc. – Posey Mill #2 Mine, 345 20th Street West, Jasper, Alabama 35501 NPDES Permit Number AL0080608, located at 100 County Road 34, Haleyville, Franklin County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation coal mining operation and associated areas, discharging to Bear Creek, Butler Falls Branch, unnamed tributaries to Bear Creek, unnamed tributaries to Butler Falls Branch, and an unnamed tributary to Swan Branch, all classified as Fish Wildlife, in the Tennessee River Basin.

MACON COUNTY

U.S. Silica Company, Inc. – Landvest Mine Site, 24275 Katy Fwy, Suite 600, Katy, Texas 77494, NPDES Permit Number AL0083500, located on Renfroe Road, Union Springs, Macon County, Alabama 36089, for issuance of a permit that limits discharges of treated drainage from an industrial sand mine and associated areas, discharging to Groundwater, unnamed tributaries to Dixie Creek, and unnamed tributaries to Calebee Creek, classified as Fish and Wildlife, in the Tallapoosa River Basin.

ST CLAIR COUNTY

Warrior Met Coal Mining, LLC – Barge Loadout, 16243 Highway 216, Brookwood, Alabama 35444, NPDES Permit Number AL0075558, located at 13701 Daniel Creek Road Brookwood, Tuscaloosa County, Alabama, for issuance of a permit that limits discharges of treated drainage from coal production transportation operation and associated areas, discharging to an unnamed tributary to the Black Warrior River, classified as Fish and Wildlife, in the Black Warrior River Basin.

Cordova Clay Company, Inc. - Riceton Hill Mine – PO Box 100, Cordova, Alabama 35550, NPDES Permit Number AL0047198, located at 3781 River Road, Cordova, Walker County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation shale and common clay mine, incidental coal mining, and associated areas, discharging to an unnamed tributary to Mulberry Fork, classified as Fish and Wildlife, in the Black Warrior River Basin.

AUTAUGA COUNTY

City of Prattville, 101 West Main Street, Prattville, AL 36067, NPDES Permit Number AL0026654, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and stormwater runoff from Prattville Autauga Creek Clean Water Facility, 1123 Rueben Road, Prattville, AL 36067, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to the Autauga Creek, which is classified as Fish and Wildlife in the Alabama River Basin.

ELMORE COUNTY

City of Prattville, 101 West Main Street, Prattville, AL 36067, NPDES Permit Number AL0027723, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and stormwater runoff from Prattville Pine Creek Clean Water Facility, 100 Pine Creek Drive, Prattville, AL 36066, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Alabama River (Woodruff Lake), which is classified as Fish and Wildlife in the Alabama River Basin and stormwater runoff to the Fay Branch, which is classified as Fish and Wildlife in the Alabama River Basin.

JEFFERSON COUNTY

Phoenix Water Resources, LLC, 606 Clay Street, Montgomery, AL 36104, NPDES Permit Number AL0078395, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Irondale WWTF, 1696 Floyd Bradford Road, Irondale, AL 35210, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Abes Creek, which is classified as Fish & Wildlife, in the Cahaba River Basin.

ST CLAIR COUNTY

City of Ashville, Post Office Drawer 70, Ashville, AL 35953, NPDES Permit Number AL0023302, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Ashville Lagoon, 405 Murray Circle, Ashville, AL 35953, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Big Canoe Creek, which is classified as Fish & Wildlife, in the Coosa River Basin.

WALKER COUNTY

Walker County Board of Education, PO Box 311, Jasper, AL 35502, NPDES Permit Number AL0051420, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Lupton Junior High School WWTP, 1110 Prospect Road, Nauvoo, AL 35578, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to UT to Buck Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.


The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record. The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.
