NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

MOBILE COUNTY

Shell Chemical LP-Mobile Facility, 400 Industrial Parkway Extension, Saraland, AL 36571, NPDES Permit Number AL0055859, located at the same address, for reissuance of a permit, which authorizes discharges resulting from process wastewater, cooling tower blowdown, sanitary wastewater, stormwater, well water filter backwash and tank bottoms and water draws through DSN001 to Chickasaw Creek, classified as Limited Warmwater Fishery (LWF), and fire pump non-contact cooling water through outfall DSN002 to Chickasaw Creek, classified as LWF, and stormwater runoff associated with petroleum refinery operations, including uncontaminated stormwater from secondary containment areas and uncontaminated hydrostatic test waters though outfalls DSN005 – DSN007, DSN010, DSN012, DSN013, DSN015 and DSN016 to Chickasaw Creek, classified as LWF and uncontaminated stormwater from secondary containment areas and uncontaminated hydrostatic test waters through outfalls DSN003, DSN004, DSN008, DSN009, DSN011, DSN014, DSN017 and DSN018 to Chickasaw Creek, classified as LWF and stormwater runoff from non-process areas including employee parking lots, administrative buildings, warehouse and access roads through DSN019 – DSN021 to Chickasaw Creek, classified as LWF.  All discharges are located in the Mobile River Basin.

Imerys Refractory Minerals USA, Inc. – Green Pit #1, 377 Highway 131, Eufaula, Alabama 36072, NPDES Permit Number AL0058131, located on Doc Green Road, Eufaula, Barbour County, Alabama, for issuance of a permit that limits discharges of treated drainage from a kaolin and bauxitic clay mine and associated areas, discharging to an unnamed tributary to Cedar Creek, classified as Fish and Wildlife, in the Choctawhatchee River Basin.

Imerys Refractory Minerals USA, Inc. – McLeod Pit #20, 377 Highway 131, Eufaula, Alabama 36072, NPDES Permit Number AL0059111, located off Click Wells Road, Eufaula, Barbour County, Alabama, for issuance of a permit that limits discharges of treated drainage from a kaolin and bauxitic clay mine and associated areas, discharging to an unnamed tributary to East Fork of the Choctawhatchee River, classified as Fish and Wildlife, in the Choctawhatchee River Basin.

Imerys Refractory Minerals USA, Inc. – Smith Lee Pit #1, Phase III, 377 Highway 131, Eufaula, Alabama 36072, NPDES Permit Number AL0057894, located on County Road 208, Eufaula, Barbour County, Alabama, for issuance of a permit that limits discharges of treated drainage from a kaolin and bauxitic clay mine and associated areas, discharging to Piney Woods Creek, classified as Fish and Wildlife, in the Choctawhatchee River Basin.

JEFFERSON COUNTY

Black Warrior Minerals, Inc. – Morris Mine, PO Box 1190, Sumiton, Alabama 35148, NPDES Permit Number AL0079707, located on 1550 Sardis Road, Gardendale, Jefferson County, Alabama, for reissuance and modification of a permit that limit discharges from a dry and wet preparation coal mining operation, incidental sandstone quarry, and associated areas, discharging to Crooked Creek, an unnamed tributary to Crooked Creek, an unnamed tributary to Turkey Creek, and an unnamed tributary Locust Fork, classified as Fish and Wildlife, in the Black Warrior River Basin.

Mays Mining, Inc. – Fishtrap Mine, 72 Longview Drive, Jasper, Alabama 35504, NPDES Permit Number AL0073075, located on 3351 Short Creek Road, Mulga, Jefferson County, Alabama, for reissuance and modification of a permit that limit discharges from a dry preparation coal mining operation, sandstone quarry, and associated areas, discharging to Locust Fork (Bankhead Lake), Fishtrap Branch, and an unnamed tributary to Fishtrap Branch, classified as Fish and Wildlife, in the Black Warrior River Basin.

MOBILE COUNTY

Trans Ash Inc.Trans Ash Borrow Pit, 15300 Highway 43, Bucks, Alabama 36512, NPDES Permit Number AL0084174, located on County Road 63, Chunchula, Mobile County, Alabama, for issuance of a permit that limits discharges of treated drainage from a construction sand and gravel, shale and common clay mine  and associated areas, discharging to an unnamed tributary to Log Creek, classified as Fish and Wildlife, in the Mobile River Basin.

WALKER COUNTY

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management has made a tentative determination to terminate NPDES Permit Number AL0074438. Compliance Associates, Inc. - Addison Rail Siding, a facility located on Whitehouse Road, Jasper, Walker County, Alabama 35501, is permitted to discharge treated drainage from a coal rail loading facility under NPDES Permit Number AL0074438. This tentative determination to terminate NPDES Permit Number AL0074438 is being made in accordance with ADEM Admin. Code r. 335-6-6-.17(c).

Public, Semi-Public and Private Facilities

WILCOX COUNTY

CWM Water Authority, 5495-B Brookside Road, Dickinson, AL 36436, NPDES Permit Number AL0084212, initial issuance of a permit which limits the discharge of pollutants from reverse osmosis from CVM Water Authority – R.O. Plant, County Road 35, Lower Peach Tree, AL 36751, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of pollutants from reverse osmosis to the Alabama River (Claiborne Lake), classified as Swimming/Fish and Wildlife, in the Alabama River Basin.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
