PROPOSED CONSENT ORDER

Calhoun COUNTY
Pursuant to the provisions of the Alabama Environmental Management Act, § 22-22A-1 et seq., Code of Alabama 1975, as amended, and Act No. 2003-397, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Kronospan, LLC., the owner/operator of a medium density fiberboard production facility in Eastaboga, Alabama.
The violations consisted of failing to comply with procedural and reporting requirements and conducting open burning of unauthorized materials.
The Department is proposing a civil penalty in the amount of $20,000. The order, if issued, would require Kronospan, LLC. to comply with the terms, limitations, and conditions of their Air Permits and the Department’s regulations.
Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to:

The comment period shall end at the close of business 30 days from the publication date of this notice. A copy of the proposed order is available on the ADEM web page at adem.alabama.gov or may be obtained by written request to the above address. A nominal fee for copying may be charged.
