PROPOSED ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Triangle Aggregates, LLC, which operates facilities located on Waterways Road and Baton Rouge Road, in Jackson, Clarke County, Alabama.
The Order addresses NPDES permit violations for discharge limitation violations, the submittal of late discharge monitoring reports (DMRs), and deficiencies and violations noted during inspections.
The Department is proposing a civil penalty in the amount of $5,200 and stipulated penalties for failure to meet milestone dates. The Order, if issued, would require Triangle Aggregates to submit an Engineering Report, and implement the corrective actions needed to comply with all provisions of NPDES Permit Number AL0067148 within 270 days from the effective date of the order.
Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention James E. McIndoe, Chief of the Water Division, P.O. Box 30l463, Montgomery, Alabama 36l30-l463. The comment period shall end at the close of business 30 days from the publication date of this notice.
