PROPOSED ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to the Tennessee Valley Authority, which operates a facility known as Widows Creek Fossil Plant located on Steam Plant Road, in Stevenson, Jackson County, Alabama.
The Order addresses NPDES permit violations for discharge limitation violations and the discharge of wastewater to waters of the State from outfalls not addressed by the Permit.
The Department is proposing a civil penalty in the amount of $25,000 and stipulated penalties for failure to meet milestone dates. The Order, if issued, would require the Tennessee Valley Authority to submit two Engineering Reports, and implement the corrective actions needed to comply with all provisions of NPDES Permit Number AL0003875 no later than the schedule set forth in the approved reports.
Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention James E. McIndoe, Chief of the Water Division, P.O. Box 30l463, Montgomery, Alabama 36l30-l463. The comment period shall end at the close of business 30 days from the publication date of this notice.
