Pursuant to the provisions of the Alabama Environmental Management Act, § 22-22A-1 et seq., Code of Alabama 1975, as amended, and Act No. 2003-397, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Nouman Malik of Calera, Shelby County, Alabama.

The violations consisted of failure to inspect for asbestos and failure to notify in writing prior to demolishing a motel in Clanton, Chilton County, Alabama.

The Department is proposing a civil penalty in the amount of $2,000. The order, if issued, would also require Nouman Malik to: immediately upon the effective date of this Consent Order and continuously each and every day thereafter, comply with all provisions of 40 C.F.R. § 61, Subpart M.

Interested persons may submit written comments, including a request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention Ronald W. Gore, Chief, Air Division, P.O. Box 30l463, Montgomery, Alabama 36l30-l463. The comment period shall end at the close of business 30 days from the publication date of this notice.
