Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-16 (2006 Rplc. Vol.), the Alabama Department of Environmental Management is proposing to issue a Consent Order to Thermalex, which operates a metal coil surface coating facility located at 2758 Gunter Park Drive West, Montgomery, Alabama 36109.

The violation consisted of failure to submit an air permit application to the Department prior to construction of new equipment.

The Department is proposing a civil penalty in the amount of $25,000. The order, if issued, would require Thermalex to comply with all requirements of ADEM Administrative Code div. 335-3 and Air Permit No. 209-0068-X007 immediately upon the effective date of the Order and continuing each and every day thereafter.
