Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-16 (2006 Rplc. Vol.), the Alabama Department of Environmental Management is proposing to issue a Consent Order to Mockingbird Gas Plant, LLC, the owner of a natural gas processing plant currently operating in Monroeville, Alabama.

The violations consisted of a failure to perform testing on each process stream that can be sent to the flare at a frequency of no less than once each six months and failure to record and maintain records of daily inspections of the flare as required by the permit.

The Department is proposing a civil penalty in the amount of $10,000. The order, if issued, would require Mockingbird Gas Plant, LLC to comply with all requirements of ADEM Administrative Code div. 335-3 and Major Source Operating Permit No. 106-0021 immediately upon the effective date of the Order and continuing each and every day thereafter.
