PROPOSED CONSENT ORDER
ACCOUNT CODE - 330
Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-16 (2006 Rplc. Vol.), the Alabama Department of Environmental Management is proposing to issue a Consent Order to Home Oil Company, Inc., owner/operator of a Gasoline Tank Truck currently operating in Cowarts, Alabama.
The violation consisted of Home Oil Company, Inc., allowing a gasoline tank truck to be filled or emptied without having a valid Department Air Sticker attached and visibly displayed.
The Department is proposing a civil penalty in the amount of $1,750.00. The order, if issued, would require Home Oil Company, Inc., to immediately upon the effective date of this Consent Order and continuously each and every day thereafter, comply with all provisions and regulations detailed in Air Permit 607-T007-X006 and 607-T007-X008-X009, ADEM Administrative Code R. 335-3-6-.20 and all other applicable air pollution control rules and regulations at all facilities at all times.

The comment period shall end at the close of business 30 days from the publication date of this notice. A copy of the proposed order is available on the ADEM web page at adem.alabama.gov or may be obtained by written request to the above address. A nominal fee for copying may be charged.
This notice is hereby given January 28, 2009, by authorization of the Alabama Department of Environmental Management.
