PROPOSED ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Mr. Robert Ward for operating an unauthorized solid waste dump located at 6780 Rester Road in Theodore, Mobile County, Alabama.
The violations consisted of Mr. Ward operating and not properly closing an unauthorized solid waste dump.
The Department is proposing a civil penalty in the amount of $28,335.00. The Order, if issued, would require Mr. Ward cease and desist the operation of the unauthorized dump, and to submit an abatement plan to the Department. This plan would require the removal and proper disposal of all regulated wastes, and a schedule for abatement completion.
Interested persons may submit written comments, including a request for a hearing, within 30 day of the publication date of this notice to:
