SOLID WASTE BRANCH – SCRAP TIRE PROGRAM
INVITATION FOR BIDS FOR SMALL SCRAP TIRE SITE REMEDIATION
Sealed bids for the removal of scrap tires, scrap tire materials, and other solid wastes located within, but not limited to, 231 Old Pioneer Road, Springville, Blount County, Alabama (approximately latitude 33.82787 and longitude -86.43226 and latitude 33.8234 and longitude -86.4433) will be received by the Alabama Department of Environmental Management (ADEM) Enforcement and Remediation Section, 1400 Coliseum Boulevard, Montgomery, Alabama until 2:00 p.m. local time, Monday, March 9, 2009. Bids will be publicly opened and read in the ADEM Main Conference Room, 1400 Coliseum Boulevard, Montgomery, Alabama on Monday, March 9, 2009, at 2:15 p.m. local time.
All bids should be submitted on a lump sum, whole project basis for the removal of all scrap tires, scrap tire materials and other solid wastes present at the above referenced site. No pre-qualification of prospective bidders will be conducted. However, all prospective bidders must ensure that they are in compliance with all local, State and federal laws regarding competitive bidding, bids submitted, and the type work to be performed under a contract for scrap tire site remediation.
Prospective bidders wishing to view the project site may access and assess the site during an open bid-preview to be held on Thursday, February 19, 2009, from 10 a.m. to 12 a.m. local time. All bidders bidding in amounts exceeding $50,000 must be licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975. Any such bids shall bear the license number of the bidder on the outside of the bid envelope. In accordance with Code of Alabama 41-16-50(c), all bidders shall furnish a bid bond on any contract exceeding ten thousand dollars ($10,000) if bonding is available for the services, equipment, or materials. All bidders, other than individuals, shall show evidence of having qualified with the Secretary of State to do business in the State of Alabama. Such evidence shall be submitted in the sealed bid envelope. All bids and documentation must be submitted via mail to the ADEM Enforcement and Remediation Section, P.O. Box 301463, Montgomery, Alabama 36130-1463, Attention: Brent A. Watson or hand delivered and logged in on the official bid register maintained at the ADEM offices located at 1400 Coliseum Boulevard, Montgomery, Alabama 36110 and must be submitted in sealed envelopes bearing the following text, "Sealed bid for small scrap tire site remediation project located North of 231 Old Pioneer Road, Springville, Blount County, Alabama , do not open before 2:15 p.m. local time, Monday, March 9, 2009". ADEM shall not be responsible for mail or other delays causing bids to be received after the deadline stated above. ADEM reserves the right to reject any and all bids and to waive any formalities in the bidding. No bids shall be withdrawn for a period of 60 days subsequent to the opening of bids without consent of the bidder.
In accordance with Code of Alabama 41-16-25, each bidder shall accompany his bid with a sworn notarized statement that he has not been a party to any agreement or collusion among bidders or prospective bidders in restraint of freedom of competition by agreement to bid at a fixed price or to refrain from bidding or otherwise. The selected bidder will be required to sign both conflict of interest (Act 2001-955 Disclosure Form) and legal worker status documentation before contracting. Complete plans and specifications for the project are as set out below and along with the contract, comprise the complete agreement and scope of work to be performed. The forms of contract documents are available for viewing during normal business hours at the ADEM offices located at 1400 Coliseum Boulevard, Montgomery, Alabama, 36110. Copies of these documents may be obtained during normal business hours at said address for charges in accordance with ADEM Administrative Code 335-1-1-.06(6).
The requested work and services shall include the following:
1. Removal of all scrap tires, scrap tire materials and solid wastes present from the site. Submittal of proper documentation of disposal or legally allowed reuse will be required for all materials removed from the site. Site closure, including hydroseeding and grading of the site will be required following materials removal, if ground disturbance occurs during remediation.
2. Compliance with all local, State and federal laws and regulations during the entirety of the project to include such work or documentation as may be required by Division 6 of the ADEM Administration Code.
3. No payment shall be made in advance of project completion.
4. All requirements of the contract must be adhered to for the entirety of the project.
5. The selected bidder will not be required to possess an Alabama Scrap Tire Transporter Permit for the transportation of scrap tires in conjunction with remediation at this site.
6. The Department may utilize any and all processes available under State law for selection and contract execution, and may, at its discretion, apply any or all provisions of Code of Alabama 335-4 for large site remediation to the remediation of small scrap tire sites as defined therein.
Liquidated damages for non-completion of work within the time limit agreed upon will be assessed in accordance with the terms of the contract.
The Alabama Department of Environmental Management does not discriminate on the basis of race, color, national origin, sex, religion, age or disability in the administration of its programs or activities, in accordance with applicable laws and regulations.
