PROPOSED ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to the City of Tuscaloosa, which operates a facility located at 3900 Kauloosa Avenue, in Tuscaloosa, Tuscaloosa County, Alabama.
The Order addresses NPDES permit violations for the submittal of late discharge monitoring reports (DMRs), failure to submit DMRs, discharging without a permit in the form of sanitary sewer overflows, failure to submit a timely and complete permit application for renewal, and discharging without a permit due to permit expiration.
The Department is proposing a civil penalty in the amount of $8,200 and stipulated penalties for failure to meet milestone dates. The Order, if issued, would require the City of Tuscaloosa to enroll in the Department’s Electronic Environmental DMR Reporting System Program, submit an Engineering Report, and implement the corrective actions needed to comply with all provisions of NPDES Permit Number AL0022713 within the timeframe listed in the Engineering Report.
Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention James E. McIndoe, Chief of the Water Division, P.O. Box 30l463, Montgomery, Alabama 36l30-l463. The comment period shall end at the close of business 30 days from the publication date of this notice.
